CITY OF RAINBOW CITY, ALABAMA – PLANNING COMMISSION – FEBRUARY 24, 2009

 

The Planning Commission of the City of Rainbow City, Alabama met in a regular session at 4:00 P.M. and upon roll call the following members were present:

 1.  Upon roll call, Chairman Thomas Moon declared a quorum was present and the   

      following business was transacted.

 

 2.  The minutes from January 27, 2009 were presented.  Jerry Tolbert made a   

      correction to Item #3, stating that it was Sam Wilson who seconded the motion 

      by Elbert Tarvin concerning Mr. Kasey Kidd’s conditional use permit request.    

      With that correction being made, Mr. Tolbert made a motion to suspend the

      reading of the minutes and approve the minutes as presented.  Elbert Tarvin

      seconded the motion.  Motion carried unanimously.

 

 3.  A public hearing that announced for the purpose of re-zoning a 47 acre more or

      less parcel of land belonging to the City of Rainbow City.  This parcel of land is

      part of the original 209 acre more or less parcel the City purchased for an

      industrial development subdivision.  The City is requested this parcel be re-

      zoned from Agricultural to M-1 Manufacturing District.  Jerome LaFollette and

      David Clontz both spoke in opposition to this development.  They are concerned

      about the traffic that will be traveling on Lumley Road.  After discussion, Wes

      Ellis moved and Jerry Tolbert seconded the motion the recommend that the

      Rainbow City Council re-zones this 47 acre parcel of land to M-1 Manufacturing

      District.  Motion carries unanimously.

 

 4.  John Smith was present with his building plans to be located at the corner of

      Nita Street and Steele Station Road.  Mr. Smith has Direct TV and will be re-

      locating to Rainbow City.  His building will be 4800 square feet including the

      office space.  After discussion, Wes Ellis moved and Elbert Tarvin seconded the

      motion to approve the building plans subject to compliance of the staff review

      comments from February 17th meeting.  Motion carried unanimously.

 

 5.  Susan Bodine was present to discuss with the Planning Commission the

      possibility of her selling plants and vegetables from her vehicle.  Mrs. Bodine

      stated she was raising seedlings and she and her brother were planting a garden

      this year.  Mrs. Bodine has received permission from Margaret Campbell who

      owns a small parcel of land along Rainbow Drive at Canoe Creek.  The zoning is

      correct for this type of trade.  It was explained to Mrs. Bodine that as long as

      she produces the products that she sells, she will not need to purchase a

      business license or charge sales tax.  But, if she decides to purchase something

      from someone else and re-sale, she will then be required to purchase a license

      and charge sales tax on all products that she sales.  Planning members

      discussed this project and decided that they need not take any action at this

      time concerning Mrs. Bodine.  They thanked her for coming and informing them

      of her intentions.

 6.  The Planning members are concerned that the City will have more people

      wanting to sale produce and other things from their vehicles.  Planning asked

      Kathy Hill to discuss with Mayor Calhoun the possibility of Rainbow City having a

      vendor’s regulation ordinance if we do not already have one.  If one is already

      in place, they suggest we have it revised.

 

 7.  There being no other business to come before The Planning Commission, Wes

      Ellis moved and Sam Wilson seconded the moved to adjourn.
