CITY OF
The
Planning Commission of the City of Rainbow City, Alabama met in a regular session
at 4:00 P.M. and upon roll call the following members were present:

1. Upon
roll call, Chairman Moon declared a quorum was present and the following
business was transacted.
2. The
minutes from November 27, 2007 were presented.
Jerry Tolbert seconded the motion to suspend
the reading of the minutes and
approve the minutes as presented. Motion carried unanimously.
3. A
public hearing was announced for the purpose of re-zoning a parcel of land that
the City of Rainbow City has
purchased. The City of Rainbow City
wishes to re-
zone this land from Agricultural to M-1
Manufacturing District to create a third
Industrial Park. The parcel consist of two phases, one to be
re-zoned now and the
other to be re-zoned at a later
date. The parcel being considered for
re-zoning
today consist of approximately 160 acres
more or less and is located on Lumley
Road and joins the City of
Johnson Construction was present in
opposition to this re-zoning. Mr.
Johnson
stated that he owns a residential
subdivision called Wyngate which joins this
property along one corner on the back
side. Mr. Johnson stated he has
approximately 2,200 feet of property that
runs along this parcel of land. He wants
a buffer zone to be added before anyone
could build in this future industrial park.
The Zoning Ordinance of Rainbow City,
Section 193 (b) states that “Where a
commercial or industrial development
adjoins a family residential lot, such
development shall require a minimum
screening height of six feet and a minimum
buffer yard width of 50 feet along the
adjoining property line”. Mr. Johnson
stated
he
would like to have 200 feet buffer zone where this property meets his
property.
Mrs. Leslie Hopper,
to this request. Mrs. Hopper stated that others wanted to
attend but were unable
to do so. Mrs. Nancy McEntyre and Mrs.
Irene Lee were present but stated they
were not in opposition to this
request. They are owners of property
that joins
this land on the other side of
After discussion, Mona Wallace made a
motion to delay the vote and study the re-
zoning request and the buffer zone before
voting. This motion died for a lack of a
second.
After further discussion, Jerry Tolbert
made a motion to recommend to the Rainbow
City Council to re-zone the 160 acres
more or less to M-1 Manufacturing District
subject to the
guidelines that are found in the Zoning Ordinance of Rainbow City.
Elbert Tarvin seconded the motion. Motion carried unanimously.
