CITY OF
The
Planning Commission of the City of Rainbow City, Alabama met in a regular session
at 4:00 P.M. and upon roll call the following members were present:

1. Upon
roll call, Chairman Thomas Moon declared a quorum was present and the
following business was transacted.
2. The
minutes from February 24, 2009 were presented.
Jerry Tolbert made a
made a motion to
suspend the reading of the minutes and approve the minutes
as
presented. Wes Ellis seconded the
motion. Motion carried unanimously.
3. Wiley
McLain represented Cody Owens and Riddles Bend Acres Subdivision.
Cody was in a meeting and could not make
the start of the Planning meeting.
Cody is asking for preliminary and final
approval on the plans for the subdivision.
No streets will have to be built and
utilities are in place. No sewer is
available
and septic
systems will be done according to the Etowah County Health
Department. All changes had been made to the drawings
from Staff Review
comments. Mark Stephens has reviewed the plans and is
OK with them. Wes
Ellis moved and Elbert Tarvin seconded
the motion to give Mr. Owens
preliminary and
final approval of his plat for Riddles Bend Acres. Motion carried
unanimously.
4. A
public hearing was announced for April Ozbilgin. Mrs. Ozbilgin is seeking a
Conditional Use Permit for a Group Care
Residence in her home at 406 Williams
Avenue.
The zoning of her home is R-1 Single Family Residential District. Mrs.
Ozbilgin stated that she and her daughter
live in the home at this time. Mrs.
Ozbilgin stated she will attend a class
in
according to
State guidelines. She stated she would
probably house teenagers
in the home and
probably not more than four (4) at a time, but she was not
completely sure
about age or quantity of people at one given time she would
have in her
home. She also stated there would be an
employee or herself at all
times in the
home. Mrs. Ozbilgin was asked about
parking area. She stated she
has a two (2)
car garage and can also park four (4) cars in the driveway for a
total of six (6)
parking spaces. The people present
speaking in opposition to this
request
were: George Stoddard,
Murphree,
concerned about the upkeep of the home, cars and delivery
trucks parking in the
street(s). This home
is at the entrance to Covered Bridge Subdivision and the
school bus picks up and lets off the children in the Covered
Bridge area at this
location. Not knowing
who will be staying at the home, the people are
concerned for the safety of the children. After discussion and review, Wes Ellis

moved that, considering the intent of the Rainbow City
Zoning Ordinance and
the zoning of the area, the application for a Conditional
Use Permit be denied by
the Planning Commission.
Jerry Tolbert seconded the motion.
Motion carried
unanimously.
(Note: A letter was sent to Mrs. Ozbilgin explaining
the appeal process that she
can go through with the Rainbow City Council.)
5. The Planning Commission members that were
present discussed honoring Mr.
John D. Watson
for his service of 36 years as a board member and President of
the Planning Commission. Mr. Watson served from March 1971
until May 2007.
Mr. Watson
served as Chairman Pro Tem from March 1973 until August 1976
when he was elected as Chairman and served in that capacity
until his
resignation. Mayor
Calhoun announced that he would be honored on April 13,
2009 at the City Council meeting at 6:30 P.M.
6. There
being no other business to come before The Planning Commission, Mona
Wallace moved and Wes Ellis seconded the moved
to adjourn.
