CITY OF RAINBOW CITY, ALABAMA – PLANNING COMMISSION – APRIL 30, 2007

 

The Planning Commission of the City of Rainbow City, Alabama met in a regular session at 4:00 P.M. and upon roll call the following members were present:

Mark Stephens, City Engineer           

 

 1.  Upon roll call, Vice Chairman Moon declared a quorum was present and the following

      business was transacted.

 

2.  Wes Ellis moved and Bryan Stone seconded the motion to suspend the reading of the minutes

      from the March 24, 2007 meeting.  Motion carried unanimously, the minutes will stand  

      approved as presented.

 

 3.  A public hearing was announced for the annexation of the Cason family property on Langdon

      Street.  Mrs. Dorothy Brewster was present representing her brothers and sisters.  Mark

      Stephens stated that there was one small parcel of property that we did not have the deed for,

      but the other land was contiguous to be annexed.  Mrs. Brewster said she could go to her

      brothers home and get the deed, so Mr. Moon allowed her to leave and return.

 

 4.  Dewayne Gurley was not present, his drawings are not completed to be presented to Planning

      Commission at this time.

 

 5.  Scott Skipper, Skipper Engineering, was present representing Dave Cummans and Ron Towers,

      owners of Montrose Gardens.  Mr. Skipper presented the final plat for Montrose Gardens,

      Addition 6, Phase 2.  The Building Department has received a check for $31,000.00 from Metro

      Bank for the paving of this section of road if the owners fail to do so.  Wes Ellis moved and

      Mona Wallace seconded the motion to give final approval on the plat.  Motion carried

      unanimously.

 

 6.  Bryan Stone moved and Jerry Tolbert seconded the motion to allow Mr. Moon, Vice Chairman,  

      to sign the plat for Montrose Gardens in place of the Planning Commission Chairman John

      Watson.  Motion carried unanimously.

 

 7.  Jerry Tolbert discussed the class that he and some other Planning members attended with UNA

      last week.  After discussion, Wes Ellis moved and Jerry Tolbert seconded the motion that when

      Staff Review comments are typed, each Staff Review sheet should have each individual name

      on it and read “no objection” instead of “no comment”.  When one member is not present, put

      that by their name.  When making comments, especially those that are opposed to approving a

      project, it should state the specificity of why they are objecting with Zoning Ordinance code and

      sections and/or Building Code sections.  Motion carried unanimously.

 

 8.  Mrs. Brewster came back with the deed that she thought was the one missing.  Mark Stephens

      read it and said that we already had that copy.   Mrs. Brewster was told that when they found the

      deed to this parcel of land the owner could come back and have it annexed into the city at that

      time.  Jerry Tolbert moved and Steve Parrish seconded the motion the recommend to the City

      Council to annex this property into the city limits of Rainbow City with R-1 Single Family

      District zoning.  This motion excludes the small portion of property in question.  Motion carried

      unanimously.

 7.  There being no more business to come before The Planning Commission, Wes Ellis moved to

      Adjourn.
