CITY OF RAINBOW CITY, ALABAMA – PLANNING COMMISSION – JUNE 24, 2008

 

The Planning Commission of the City of Rainbow City, Alabama met in a regular session at 4:00 P.M. and upon roll call the following members were present:

 1.  Upon roll call, Chairman Moon declared a quorum was present and the following

      business was transacted.

 

 2.  The minutes from May 27, 2008 and June 10, 2008 were presented.  Wes Ellis

      moved and Jerry Tolbert seconded the motion to suspend the reading of the

      minutes and approve the minutes as presented.  Motion carried unanimously.

 

 3.  Cody Owens was present seeking re-zoning of a parcel of land he has purchased on 

      Riddles Bend Road.  The parcel consists of 5 acres more or less.  Mr. Owens is

      seeking to have the zoning changed from Agricultural to R-1 Single Family

      Residential District.  He will subdivide the property, in the future, according to the

      zoning requirements.  After discussion, Jerry Tolbert moved and Elbert Tarvin

      seconded the motion to recommend to the Rainbow City Council to rezone the

      property to R-1 Single Family Residential District.  Motion carried unanimously.

 

 4.  The Planning members discussed the issuance of bonds for street construction in

       new subdivisions.  The City already has in place requirements for bonds that can

       be found in the Zoning Ordinance of Rainbow City in Section 315, Street

       Construction Standards, sub-section (s).  Planning members discussed the need to

       have future property owners be made aware of any streets in subdivisions that are

       to remain private streets and owned by the property owners.  Jerry Tolbert has

       asked that the legal staff advice the City Planning Commission if the commission

       can require a section on a person’s deed that states “streets in this development

       are to remain private and maintenance is the responsibility of the property

       owner(s)”. 

 

 5.  There being no other business to come before The Planning Commission, Wes Ellis

      moved to adjourn.
