CITY OF RAINBOW CITY, ALABAMA – PLANNING COMMISSION – NOVEMBER 27, 2007

 

The Planning Commission of the City of Rainbow City, Alabama met in a regular session at 4:00 P.M. and upon roll call the following members were present:

 1.  Upon roll call, Chairman Moon declared a quorum was present and the following

      business was transacted.

 

2.   The minutes from September 25, 2007 were presented.  Wes Ellis moved and

      Bryan Stone  seconded the motion to suspend the reading of the minutes and  

      approve the minutes as presented.  Motion carried unanimously.

 

 4.  A public hearing was announced for the changes and/or additions to the Rainbow

      City Zoning Ordinance and the Subdivision Regulations.  They are as follows: 

           (1)  Change in Zoning Ordinance - Section 146 - paragraph (a) and (b)               

          Setbacks for accessory buildings shall be 7.5 feet from any side or rear

          property line.

          (2) Add to Zoning Ordinance - Section 314paragraph (a) (7) All new

          subdivision’s shall be tied to The State Plane Coordinate, both Vertical

          and Horizontal Datum. 

          This will become an addition to the Subdivision Regulations at Section 15

          (c) (17).

          (3)  Add to Zoning Ordinance -  Section 83 -  HC-RL  – This section will    

          be for restaurant liquor sales, which when zoned with this RL suffix, will state

          that to be zoned HC-RL 60% of total sales shall come from food sales. 

      There was no one present in opposition to these changes.  After review and

      discussion, Wes Ellis moved and Larry Harris seconded the motion to recommend

      to the Rainbow City Council the additions and changes to the Zoning Ordinance,

      with the addition to the Subdivision Regulation being approved tonight.  Motion

      carried unanimously. 

    

 5.  Chelsea Lane was next on the agenda.  The City has received numerous complaints

      concerning the cul-de-sac on Chelsea Lane being in bad condition and people

      turning in the residents driveways instead of in the cul-de-sac.  This was discussed

      during Staff Review and Laura Lloyd suggested that she would write a letter to the

      developers about this concern.  Mrs. Lloyd presented the members with a copy of

      the letter and stated she would mail the letter to the owner(s).  No action was

      taken on this matter tonight.

     

 6.  Planning Members were presented with a copy of the Stormwater Ordinance No.

      455 that was adopted by the Rainbow City Council on October 29, 2007. 

 

 7.  It was announced that the Planning Commission meeting in December will be    

      cancelled unless an emergency arises.

 8.  Mayor Calhoun addressed the Planning Commission members and thanked them for

      volunteering their time each month to attend the meetings and the great job that

      they are doing for the City.  He told the members about the new retail development

      that is in “the works” on Rainbow Drive across from the Winn Dixie Shopping   

      Center.  He also stated that hopefully the Japanese Steakhouse that is planned

      behind Burger King will get started after the first of the year.  Mayor Calhoun told

      the members about the 209 acres of land Rainbow City has purchased on Lumley

      Road for an industrial park.  The City has sold all available land in the first two

      parks and now will start development on the third industrial park.  The City also

      purchased the chert pit in St. Clair County from Clarence Rhea’s heirs for the City

      to have chert for its use.  Mayor Calhoun also stated that the City awarded the bid

      Monday night at Council meeting for the construction of the concession stand at

      Vivian Maddox Sports Complex to Bobby Dale Welch Construction.

 

9.  There being no other business to come before The Planning Commission, Bryan

      Stone moved to adjourn.
