CITY OF RAINBOW CITY-COUNCIL MEETING-MARCH 28, 2005

 

The City Council of the City of Rainbow City, Alabama, met in regular session at City Hall at 6:30 P. M., and upon roll call the following members were present:

 

Terry John Calhoun, Mayor

 

Council members:

 

Jeff Overstreet

Bobby McCartney

Lloyd Matthews

Bryan Stone

Kris Cornutt

 

The same constituting a quorum of the City Council, the following business was transacted.

 

1.   The meeting was called to order by Mayor Terry John Calhoun.

 

2.  Invocation was given by Bobby McCartney.

 

3.  Mayor Calhoun led the pledge of allegiance to the flag.

 

4.  The minutes of March 14, 2005 were approved as presented.

 

5.  Mayor Calhoun reported that the clerk opened bids for the surplus vehicles today at 2:00 P. M. and there were twenty-one (21) bidders.   The high bidder was Mr. Shun Snyder.  He bid $1355.00 for the 1996 Dodge Stratus, $l055.00 for the 1995 Nissan Altima, and $3550.00 for the 1996 Chevrolet Tahoe.   Jeff Overstreet moved and Bryan Stone seconded the motion to accept the bids.   Mayor Calhoun declared the motion carried.

 

6.  Mayor Calhoun announced that a public hearing was being held concerning Ordinance no. 421.    This ordinance is making changes to the zoning ordinance.  (copy attached)  He asked if there is anyone for or against the ordinance.  There was no response.  Bobby McCartney made a motion to introduce the ordinance.   Bryan Stone moved and Kris Cornutt seconded the motion to suspend the rules for immediate consideration.   Mayor Calhoun asked for a roll call vote as follows:

Mayor Calhoun declared the motion carried.

 

7.  Jeff Overstreet moved and Bryan Stone seconded the motion to adopt Ordinance No. 421.  Mayor Calhoun asked for a roll call vote as follows:

Mayor Calhoun declared the motion carried.

 

8.  Mayor Calhoun recommended changing the web page for the city to Internet Resource Center.  The contact person is Mr. Lee Warren.  The initial setup will be $2975.00, and then $170.00 per month which will include site content management, web hosting, e-mail systems and

search engine promotion.  The city’s contact person will be Beth Lee.  Bryan Stone moved and Kris Cornutt seconded the motion to approve the recommendation.    Mayor Calhoun declared the motion carried.

 

9.  Mayor Calhoun presented the following travel\tuition:

            Sharon Wagnon to attend the Alabama Municipal Court Clerk and Magistrates Association Certification Training in Tuscaloosa, May 11-13, 2005.

Bryan Stone moved and Bobby McCartney seconded the motion to grant the travel\tuition.   Mayor Calhoun declared the motion carried.

 

10.  Mayor Calhoun presented the following list of property at the Recreation Department be declared as surplus:    l.  Used fencing, posts, gates and various hardware

                                   2.  Three mowing decks, one John Deere 60” cut and two Ransome 72 “                                         cut

Bryan Stone moved and Bobby McCartney seconded the motion to declare this property as surplus.   Mayor Calhoun declared the motion carried.

 

11.  Kris Cornutt moved and Bobby McCartney seconded the motion to take bids on the surplus property in the Recreation Department and close the bids April 11, 2005 at 2:00 P. M.   Mayor Calhoun declared the motion carried.

 

12.  Mayor Calhoun presented an application from Stop N Save #119 (old Speedy’s location)

 owned by Salah El-Din Al-Abbasi to transfer the application for retail table wine (off premises only) and retail beer (off premises only)  to the new owner.  Bryan Stone moved and due to lack of a second the motion died.  After further discussion, Bryan Stone moved and Bobby McCartney seconded the motion to approve the transfer.   Mayor Calhoun declared the motion carried.

 

13.  Mayor Calhoun announced that Peggy Shrum will be retiring April 1, 2005 and Donna Kilgore will take her place.  He recommended a one-step pay increase for Donna, since she is changing positions.  (Range 25 Step 20).    Bryan Stone moved and Jeff Overstreet seconded the motion to grant the pay increase.  Mayor Calhoun declared the motion carried.

 

14.   Mayor Calhoun thanked Larry Murray and all the employees who helped make the Easter egg hunt such a great success.  He said about 300 kids showed up.    He said he would also like to thank the business people of  Rainbow City who donated the prizes.

 

15.   Lloyd Matthews reported to the council that a sanitation employee had been stuck by a hypodermic needle.    The lady who threw the needle away was a diabetic.   He asked that everyone put their used needle in a plastic bottle and seal it.  The department is in the process of purchasing new gloves that are stick proof.    He also asked that the council study and come up with raises for all the employees.

 

16.  Kris Cornutt said he agreed with Lloyd, and would like for all the citizens to consider the plight of the sanitation employees and try to secure anything that might harm them.  He  said this is a heavy time for trash pick up, and asked that everyone put it out early.

 

17.  Mayor Calhoun announced that Fred’s grand opening will be Friday, April l, at 8:45 A. M.

 

18.  Jeff Overstreet announced that applications for police chief will be closing Tuesday, March 29, 2005 at 2:00 P. M.    He also announced that the council had a meeting with a firm out of Athens, Georgia,  Condrey and Associates earlier this month, and after consideration decided the city needs a feasibility study to access the needs of the fire department.   The changes recommended by this study will benefit the employees and the city.   The cost of the study is $7500.00 and $1000.00 for the benchmark study.    Jeff Overstreet moved and Bryan Stone seconded the motion to hire the firm to do the study.   Mayor Calhoun asked for a roll call vote as follows:

18.  Bobby McCartney commended Eddie at the Recreation Department and Sue at the Community Center for the good job they do and the good job their staff does.   He also reported that ball season opens tonight.

 

19.  Jeff Harwood reported on the nuisance abatement at 4551 Lister Ferry Road.   He said cleanup is in progress.  Discussion followed.    

           

There being no further business to come before the Council at this time,  Bryan Stone made a motion to adjourn.
