CITY OF RAINBOW CITY-COUNCIL MEETING-JANUARY 9, 2006

 

The City Council of the City of Rainbow City, Alabama, met in regular session at City Hall at 6:30 P.M., and upon roll call by the City Clerk, Barbara T. Wester, the following members answered present:

 

Terry John Calhoun, Mayor

 

Council members:

Kris Cornutt

 

The same constituting a quorum of the City Council, the following business was transacted.

 

1.  The meeting was called to order by Terry John Calhoun.

 

2.  Invocation was given by Bobby Joe Winningham, Pastor of McEntyre Baptist Church.

 

3.  Mayor Calhoun led the pledge of allegiance to the flag.

 

4.  Mayor Calhoun presented the minutes of  December 12, 2005 for review, and asked if there were any corrections, additions, or deletions.   There being none, Bryan Stone moved and Bobby McCartney seconded the motion to approve the minutes as presented.

Mayor Calhoun declared the motion carried.

 

5.  Mayor Calhoun recognized Pat Adkison with Proclamation No. 05-04.   Mayor Calhoun stated that Mr. Adkison and his wife Linda have been residents of Rainbow City for several years, and that Mr. Adkison began umpiring ASA softball in 1966 and serving as Commissioner since 1972 in Alabama.  He has been President of the Amateur Softball Association four times, being the only person to do this.   He also played a role in getting softball in the Olympics while President and has been a voting delegate of the United States Olympic Committee nine times.   He has been inducted in the ASA National Hall of Fame, Oklahoma Hall of Fame, Indiana Hall of Fame, and the West Alabama Sports Hall of Fame.  He has played an active role in getting softball tournaments on the district, state, regional, and national level to this area creating a tremendous economic impact to Etowah County.  He is retiring from the ASA Commissioner position effective February l, 2006.  Mayor Calhoun then presented Mr. Adkison with a key to the city.   Mr. Adkison thanked the Mayor and spoke concerning his years in baseball.

 

6.  Mayor Calhoun presented the Solid Waste Disposal Contract with Three Corners Regional Landfill, and asked the council to give him the authority to sign the contract.  He stated everything in the contract stays the same as the original contract.   Kris Cornutt moved and Bobby McCartney seconded the motion to grant the mayor authority to sign the contract.   Mayor Calhoun declared the motion carried.

 

7.  Mayor Calhoun asked the Building Official, Wiley McLain to comment on reroofing the gym at the Recreation Center.  Wiley stated that Stephen Ward & Associates, Inc. is a group that specializes in roofing design.  They take care of all the paperwork, write the specs, and handle the bids.  They get 8% for handling the job, and the roof will have a twenty year guarantee.   They did the library and community center.  Bobby McCartney

moved and Lloyd Matthews seconded the motion to let Stephen Ward & Associates, Inc. handles the gym reroofing.  Mayor Calhoun declared the motion carried.

 

8.  Mayor Calhoun announced that Dr. Ben Hester, Pediatrician is opening an office in Rainbow City in Dr. Cross’s old office in the Gregerson Building.

 

9.  Mayor Calhoun presented the following departmental reports:  Library, Court, Community Center,  Police & Animal Control, Building and Fire and Rescue.

 

10.  Mayor Calhoun presented the following travel\tuition:

            Tina Brooks, Library Director to attend the Administrators Meeting at APLS (Alabama Public Library Service) in Montgomery on January 26, 2006.

            Tina Brooks and Dianne Mullinax to attend the Alabama Library Association Public Library Division Winter Mini Conference a the Homewood Public Library on January 27, 2006, at a cost of $40.00 registration per person.

            Animal Control Officer Dedera Wilson to attend the “Euthanasia by Injection” class in Huntsville, Alabama, January 18-19, 2006 at a cost of $219.00 tuition and hotel fee for one night.  This class is mandatory for Officer Wilson to be certified to perform euthanasia.

            Barbara Wester, City Clerk to attend the Winter 2006 Certification training Institute for Municipal Clerks and Administrators and Master Municipal Clerk Academy, February 8-10, 2006 at the Bryant Conference Center, Tuscaloosa, Alabama.  Registration is $195.00.

Lloyd Matthews moved and Bobby McCartney seconded the motion to grant the travel\tuition.   Mayor Calhoun declared the motion carried.

 

11.  Mayor Calhoun presented the travel policy revision.  Discussion followed.  Bryan Stone moved and Jeff Overstreet seconded the motion to adopt the policy revision.   Mayor Calhoun declared the motion carried.

 

12.  Mayor Calhoun presented an ad request (sign for fence) from Melton Ledbetter for Southside Girl’s Softball Team in the amount of $200.00.   Lloyd Matthews moved and Kris Cornutt seconded the motion to purchase the ad.   Mayor Calhoun declared the motion carried.

 

13.  Mayor Calhoun presented an ad request from the Gadsden Times.  Bryan Stone moved and Bobby McCartney seconded the motion to purchase a half page color ad in the amount of $1335.00.   Mayor Calhoun declared the motion carried.

 

14.  Mayor Calhoun reported that the repeater system for the Police Department is up and operational.   The Gadsden Etowah Emergency Management Agency and Etowah County E911, (Bill Broder) provided this equipment at no cost to the city.  The repeater system consists of antennas, radios (6), two 27” monitors, (for ease of viewing), for NCIC.   $l5,000.00 was provided by the Gadsden Etowah EMA through a grant from Homeland Security and  four (4) dispatch consoles (furniture) valued at $l3,000.00, and an instant playback recorder, (10 minute loop digital) valued at $2000.00 was purchased.

 

 

15.  Mayor Calhoun reported that the Chocolate Festival will be April 8, 2006.  It will be held in conjunction with the Chamber of Commerce and Tourism Board at the Rainbow Plaza.

 

16.  Lloyd Matthews discussed raises for city employees.  Discussion followed.

 

17.  Kris Cornutt reported that the new trash schedule is in operation and the city is only picking up natural wood products.  Leaves and limbs should be bagged.

18.  Bryan Stone announced that a work session will be held Wednesday, January 11, 2006 in the conference room.

 

19.  Jeff Overstreet thanked Rick Hill for all the work he has done in the Communications Department.

 

20.  Bryan Stone moved and Lloyd Matthews seconded the motion for the council to go into Executive Session to discuss city litigation with Jim Turnbach, city attorney.

 

21.  City Attorney, Jim Turnbach announced that the 11th Circuit Court of Appeals in Atlanta ruled in favor of the city concerning the lawsuit of Randy and Marty Campbell.

 

22.  Mayor Calhoun announced the council would recess into Executive Session to discuss litigation with the attorney.

 

23.  The mayor and council returned from Executive Session and Kris Cornutt moved and Bryan Stone seconded the motion for the council to resume the council meeting.

 

There being no further business to come before the council at this time, Jeff Overstreet made a motion to adjourn.
