CITY OF RAINBOW CITY-COUNCIL MEETING-MARCH 27, 2006

 

The City Council of the City of Rainbow City, Alabama, met in regular session at City Hall at 6:30 P.M., and upon roll call by the City Clerk, Barbara T. Wester, the following members answered present:

 

Terry John Calhoun, Mayor

 

Council members:

 

Jeff Overstreet

Bobby McCartney

Lloyd Matthews

Bryan Stone

Kris Cornutt

 

The same constituting a quorum of the City Council, the following business was transacted.

 

1.   The meeting was called to order by Terry John Calhoun.

 

2.  Invocation was given by Bobby McCartney.

 

3.  Mayor Calhoun led the pledge of allegiance to the flag.

 

4.  Mayor Calhoun presented the minutes of March  13, 2006 for review, and asked if there were any corrections, additions, or deletions.   There being none, Kris Cornutt moved and Lloyd Matthews seconded the motion to approve the minutes as presented.

 

5.  Mayor Calhoun stated that bids were opened in the Council Chambers, Friday, March 24, 2006 for the lease purchase of two (2) fire trucks.  Only one bid was received.  Pierce

Mfg. Company bid $603,948.00.  A no bid was received from Sunbelt Fire.  Jeff Overstreet moved and Lloyd Matthews seconded the motion to accept the bid of Pierce for the lease\purchase and to take the money out of the Fire District Fund for five (5) years.    Mayor Calhoun declared the motion carried.

 

6.  Mayor Calhoun asked that the records show that no bids were received for the computer equipment in the library. 

 

7.  Mayor Calhoun stated that two (2) bids were received for the computer equipment and miscellaneous items located in the Storage/Exercise Room on the 2nd floor of the Municipal Building.  Susan Silvey bid $30.00 for a wooden bookcase and Beth Lee bid $5.00 for a H. P. Deskjet 890C.   Bobby McCartney moved and Kris Cornutt seconded the motion to accept the two (2) bids.   Mayor Calhoun declared the motion carried.

 

8.  Mayor Calhoun recommended the appointment of Kaye Farley as Court Clerk.   Bryan Stone moved and Lloyd Matthews seconded the motion to appoint Kaye as Court Clerk.   Mayor Calhoun declared the motion carried.

 

9.  Mayor Calhoun announced that a public hearing was being held concerning Ordinance No. 431.   Rainbow Plaza Associates are wishing to rezone the property behind the Old Foodworld Building (vacant) from R-2, Patio and Garden Homes to R-3, Multi Family District.  They want to build an apartment complex on this property consisting of seven (7) buildings with sixteen (l6) dwelling units per building.  The property consists of 9.29 acres adjacent to Rainbow Plaza.    Mayor Calhoun asked if there was anyone who wanted to speak for or against the ordinance.  Tom Davis spoke concerning the ordinance.  Discussion followed.  Bryan Stone made a motion to introduce the ordinance.

10. Jeff Overstreet moved and Bryan Stone seconded the motion to suspend the rules for immediate consideration.  Mayor Calhoun asked for a roll call vote as follows:

Mayor Calhoun declared the motion carried.

 

11.  Bryan Stone moved and Lloyd Matthews seconded the motion to adopt Ordinance No. 431.  Mayor Calhoun asked for a roll call vote as follows:

                                                Lloyd Matthews         yes

                                                Bryan Stone                no

                                                Kris Cornutt                no

 

Mayor Calhoun stated the motion did not carry.

 

12.  Kris Cornutt reminded everyone that on April 6, 2006, Nancy Shaw, the award winning children’s author will be at the library.                     

 

13.  David Kimberly appeared before the Council announcing that he was running for Circuit Judge.   Discussion followed.

 

14.  Mayor Calhoun announced that Ann Roberts retired from the Community Center, March 16, 2006.

 

There being no further business to come before the Council at this time, Bryan Stone made a motion to adjourn.
