CITY OF RAINBOW CITY-COUNCIL MEETING-APRIL 9, 2007

 

The City Council of the City of Rainbow City, Alabama, met in regular session at City Hall at 6:30 P.M., and upon roll call by the City Clerk, Barbara T. Wester, the following members answered present:

The same constituting a quorum of the City Council, the following business was transacted.  

 

1.  The meeting was called to order by Mayor Calhoun.

 

2.  Invocation was given by Bryan Stone.

 

3.  Mayor Calhoun led the pledge of allegiance to the flag.

 

4.  Mayor Calhoun presented the minutes of March 26, 2007 for review and asked if there were any corrections, additions, or deletions.  Mayor Calhoun stated that Item 10 should state that Mr. Tarvin will be paid $2.00 per household for going door to door to do the survey of the residents of the trailer parks.  There are l9l households.   He stated they have been working on the survey for two (2) weeks.  Others that helped were his secretary Beth Lee, Gary Chandler and his wife, and Diane McClellan from East Alabama.   Bryan Stone moved and Bobby McCartney seconded the motion to approve the minutes with this correction to Item 10. Mayor Calhoun also added that of the three (3) trailer parks, applications have been completed totaling 86%, 85%, and 83%.  There has to be 80% of the applications completed to count as the survey, and 5l% has to be low to moderate income to qualify for the drainage grant.  The paperwork will be turned in  Wednesday, April 11, and the public hearing for the grant will be April 16, 2007.

 

5.  Mayor Calhoun presented Resolution No. 07-02, a written citizen participation plan which is essential for establishing procedures to ensure all citizens have the opportunity to participate in the development of the local Community Development Block Grant Program; and the plan provides for a public hearing to be held to solicit public input.  Rainbow City does not have a newspaper, so all public meeting notices are posted in a least three locations frequented by the public.   Cora Kelly moved and Bryan Stone seconded the motion to adopt the resolution.  Mayor Calhoun declared the motion carried.

 

6.  Mayor Calhoun presented the resignation of Nancy Cosby from the Rainbow City Library Board.   He stated Nancy has been on the board a long time, and he hates to see her leave.  He thanked her for her time on the board.  Kris Cornutt moved and Lloyd Matthews seconded the motion to accept the resignation.  Mayor Calhoun declared the motion carried.   Kris Cornutt thanked Nancy for all her hard work, and stated that this was a task that she truly took to heart.

 

7.  Mayor Calhoun asked that the records show that the council received copies of the monthly reports, and asked them if they had any questions or comments. There were none.

8.  Mayor Calhoun presented Ordinance No. 445, the Sales Tax Holiday, beginning the first Friday in August  2007 and ending at twelve midnight the following Sunday, and each year thereafter until rescinded.  Act 2006-574 exempts “covered items” (certain school supplies, clothes and computers) from municipal sales and use tax during this period.   Lloyd Matthews made a motion to introduce the ordinance.  Kris Cornutt moved

and Lloyd Matthews seconded the motion to suspend the rules for immediate consideration.  Mayor Calhoun asked for a roll call vote as follows:

Mayor Calhoun declared the motion carried.

 

9.  Cora Kelly moved and Bryan Stone seconded the motion to adopt Ordinance No. 445.   Mayor Calhoun asked for a roll call vote as follows:

Mayor Calhoun declared the motion carried.

 

10.  Mayor Calhoun presented a change order request for fencing at the Vivian Lee Maddox Sports Complex in the amount of $8662.00.  Eddie Cline, Recreation Director stated this was an add-on for a fence in between fields and fencing around the electrical box.  Bobby McCartney moved and Lloyd Matthews seconded the motion to pay the $8662.00 for the change order.  Mayor Calhoun declared the motion carried.

 

11.  Mayor Calhoun presented a request from Chief Ragan to declare the following vehicles as surplus and put on GovDeals.com.   (l)  2001 Ford Crown Vic, white, serial number 5744,   (2) 1999 Ford Crown Vic, white, serial number 1730, as is, with equipment, to take bids from other law enforcement agencies.   Cora Kelly moved and Bryan Stone seconded the motion to declare the vehicles as surplus and put on GovDeals.com.   Mayor Calhoun declared the motion carried.

 

12.  Mayor Calhoun presented a request from Chief Ragan to replace the radio recorder in dispatch, which broke.  He requested the city purchase the radio from Allcomm Communication for $6,525.00.   Cora Kelly moved and Lloyd Matthews seconded the motion to purchase the recorder from Allcomm.   Mayor Calhoun declared the motion carried.

 

13.  Mayor Calhoun stated that the trash truck has been broke down since last Wednesday.  It should be ready by next Thursday.  The city is trying to lease a truck from Talladega.

 

14.  Lloyd Matthews thanked Nancy Cosby for all her dedicated work while serving on the Library Board.   He stated he spoke with Commissioner Choate concerning the paving on Sutton Bridge Road, and the paving should be finished by August.  He spoke with Commissioner Overstreet concerning Riddles Bend Road and it should be paved by the end of May.    He and the mayor met with the engineer and the State concerning Brown Avenue, and are waiting on the engineer to get his drawings to the MPO.

 

15.  Bobby McCartney thanked the Street and Recreation Department for the work they have done recently on the Maddox Complex.

 

16.  Chief Ragan informed the council that Dallas McElroy’s Plumbing offered to replace all parts and labor at no cost to the city to repair the two (2) bathrooms at Rainbow

Landing. The Chief also asked the council to put two (2) new dead bolts on the bathrooms to make them more secure.   Mr. McElroy stated that the three (3) commodes were donated by Noland’s Plumbing.   Bobby McCartney moved and Lloyd Matthews seconded the motion to allow Dallas’ Plumbing to repair the two bathrooms and to accept the commodes donated by Noland’s of Gadsden; and for the city to put the dead bolt locks on.   Mayor Calhoun declared the motion carried.

 

17.  Melvin Potter, on behalf of Larry Murray thanked the council and all who helped with the annual Easter Egg Hunt.   Mayor Calhoun thanked everyone who helped with the Easter Egg Hunt, and stated that the Chocolate Festival would be this Saturday, April 14.   Lloyd Matthews thanked the fireman for all their help with the Friday Easter Egg Hunt at the school.

 

There being no further business to come before the council, Bryan Stone made a motion to adjourn.
