CITY OF RAINBOW CITY-COUNCIL MEETING-APRIL 24, 2006

 

The City Council of the City of Rainbow City, Alabama, met in regular session at City Hall at 6:30 P.M., and upon roll call by the City Clerk, Barbara T. Wester, the following members answered present:

 

Terry John Calhoun, Mayor

 

Council members:

 

Jeff Overstreet

Bobby McCartney

Lloyd Matthews

Bryan Stone

Kris Cornutt

 

The same constituting a quorum of the City Council, the following business was transacted.

 

1.  The meeting was called to order by Terry John Calhoun.

 

2.  Invocation was given by Bryan Stone.

 

3.   Mayor Calhoun led the pledge of allegiance to the flag.

 

4.  Mayor Calhoun presented the minutes of April 10, 2006 for review, and asked if there were any corrections, additions, or deletions.  Bryan Stone moved and Bobby McCartney seconded the motion to approve the minutes as presented.

 

5.  Mayor Calhoun presented a request from Chief Ragan to extend the posting for police officer until May 12, 2006 at 2:00 P.M.  Jeff Overstreet moved and Bryan Stone seconded the motion to extend this posting.  Mayor Calhoun declared the motion carried.

 

6.  Mayor Calhoun presented Resolution No. 06-02 to revise the City Personnel Manual.  Bryan Stone moved and Jeff Overstreet seconded the motion to adopt the manual.   Mayor Calhoun recognized Wiley McLain, Building Official.  He stated that he was on the committee to revise the manual, but only met one time.  Mayor Calhoun asked for a roll call vote:

Mayor Calhoun declared the motion carried.

 

7.  Mayor Calhoun presented Resolution No. 06-01, a revision of the Police Department Manual.   Jeff Overstreet stated that SECTION 1.03, REVISIONS OR ADDITIONS TO POLICY should read :   The chief of police, command staff, departmental supervisors, city attorney are the only persons whom will draft, change, or incorporate any policy, procedure, directive, or order added to or revised in this manual, subject to City Council approval.  The sentence:  All policy and procedure will be final approved by the Chief of Police and added or revised by the Chief of Police shall be deleted.  SECTION 0.03 DISTRIBUTION

 A shall read:  After approval by the Chief, and the City Council, the final copy of the policy will be updated, printed and placed in the Policies and Procedure manual.    Jeff Overstreet moved and Bryan Stone seconded the motion to adopt the manual with these changes.  Mayor Calhoun declared the motion carried.

 

8.  Mayor Calhoun stated that he was appointing Jerry Tolbert to represent the council on the Grievance Committee.  He asked Chief Ragan to get with Mr. Tolbert and the employee who filed the grievance to appoint their representative.

 

9.  Mayor Calhoun asked that the records show that the MPO called and asked him to appoint two (2) citizens to be on the advisory committee for them.  He appointed Elbert Tarvin and Wiley McLain. 

 

10.  Bobby McCartney discussed changing the hours at the walking track behind Rainbow Middle School and the track located off Williams Avenue.  Discussion followed.   Bobby moved and Lloyd Matthews seconded the motion to change the hours from 4:00 a.m. to 11:00 p.m.   Mayor Calhoun declared the motion carried.   Mayor Calhoun stated that Eddie Cline will post signs pertaining to the changes.

 

11.  Mayor Calhoun presented a list of items from the Community Center and Recreation Department to be declared as surplus.  Kris Cornutt moved and Lloyd Matthews seconded the motion to declare these items as surplus and open bids at the next council meeting.   Mayor Calhoun declared the motion carried.   Mayor Calhoun stated the items would be on display at the Recreation Center.

 

12.  Bobby McCartney moved and Bryan Stone seconded the motion to send out bids to purchase top soil for the Vivian Lee Maddox Sports Complex.  (Pioneer)  and open bids May 4, 2006 at 3:00 p. m.   Bobby stated that this soil will help complete the ball fields.

Mayor Calhoun declared the motion carried.

 

13.  Mayor Calhoun asked the council to purchase two (2) acres of land from Mr. Dalton Freeman at a price of $5500.00 per acre.  This property borders Lumley Road on one side and city property on the other side giving us the ability to have access to the Vivian Lee Maddox property from Lumley Road.    Bobby McCartney moved and Lloyd Matthews seconded the motion to purchase this property for a total of $11,000.00 for two (2) acres.   Mayor Calhoun declared the motion carried.

 

14.  Mayor Calhoun asked the council to allow him to sign an agreement with BellSouth to upgrade the telephone system for a T1 line for a cost of $5250.00.  The T1 line will bring the phone bill down $450.00 to $500.00 per month.   Jeff Overstreet moved and Lloyd Matthews seconded the motion to allow the mayor to sign this contract.   Mayor Calhoun declared the motion carried.

 

15.  Mayor Calhoun stated that Tom Quinn of the Chamber wrote a letter to plaza owners thanking them for allowing the city to use the property for the Chocolate Festival. 

 

16.  Kris Cornutt stated that registration for the Summer Reading Program at the library starts May 17, 2006.

 

17.  Bryan Stone asked council members to start putting together their budgets.  He will need this by August.

 

18.   Jeff Overstreet moved and Lloyd Matthews seconded the motion to change the base pay for firefighters to $10.50 per hour effective immediately.   Mayor Calhoun declared the motion carried.

 

19.  Jeff Overstreet stated that no response was received from other cities for part-time firefighters.  Jeff moved and Lloyd Matthews seconded the motion to post two (2) firefighter/paramedic positions until Friday, May 15, 2006 at 2:00 p. m.   Mayor Calhoun declared the motion carried.   Jeff also thanked the firefighters for the job they did when J. B. Jeffers house burned.

 

 

20.  Bobby McCartney stated that 50% of the roof is completed at the recreation center.

 

21.  Larry Murray thanked the council for postings the two (2) positions for the fire department.

 

22.   Jeff Overstreet moved and Bryan Stone seconded the motion to recess the meeting until May 4 at 2:00 P. M.
