CITY OF RAINBOW CITY-COUNCIL MEETING-JUNE 13, 2005

 

The City Council of the City of Rainbow City, Alabama, met in regular session at City Hall at 6:30 P. M., and upon roll call the following members were present:

 

Terry John Calhoun, Mayor

 

Jeff Overstreet

Bobby McCartney

Lloyd Matthews

Bryan Stone

Kris Cornutt, absent

 

The same constituting a quorum of the City Council, the following business was transacted.

 

1.  The meeting was called to order by Mayor Terry John Calhoun.

 

2.  Invocation was given by Jeff Overstreet.

 

3.  Mayor Calhoun led the pledge of allegiance to the flag.

 

4.  Mayor Calhoun presented the minutes of May 23, 2005 and special called meeting of May 31, 2005, and asked if there were any changes or additions.  There being none, Lloyd Matthews moved and Bobby McCartney seconded the motion to approve the minutes as presented.

 

5.  Mayor Calhoun announced that no bids were received for the cleaning of city hall, but that several specs had been picked up.   There was only one bid received for the cleaning of the library and community center.  Larry Mackey Cleaning Service had a bid of $l800.00 per month or a second bid of $l6.00 per hour to clean the building, set-up for parties and strip and wax floors for both buildings.

Discussion followed.  Bryan Stone moved and Jeff Overstreet made a motion to table the bid until the city attorney can get an opinion from the Alabama League of Municipalities to see if an employee can hold both positions.   Mayor Calhoun declared the motion carried.

 

6.  Mayor Calhoun announced that three (3) bids were received for the fuel usage for the city gasoline and diesel fuel.   Brown Oil Company,  McPherson Oil and Jack Green Oil Company.    Discussion followed.   Bryan Stone moved and Lloyd Matthews seconded the motion to table the bids until they can look into it further and get the type of gas and quality the city needs.   Mayor Calhoun declared the motion carried.

 

7.  Mayor Calhoun announced that the Detective Division is holding items in several locations that need to be declared as surplus and sold at public auction.  Most of the items have been held for a period of two years.  These items have been confiscated, seized, or forfeited by the circuit courts of Etowah County, or are property that has accumulated throughout the years from cases worked.   The department has exhausted all efforts to find owners for this property.  Bobby McCartney moved and Bryan Stone seconded the motion to declare this property as surplus.   Mayor Calhoun declared the motion carried.

8.  Jeff Overstreet moved and Lloyd Matthews seconded the motion to auction this property July 16, 2005.  It can be viewed from 7:00-9:00 a.m. at the fire bay in the municipal building, with the auction starting at 9:00 a. m.    Mayor Calhoun declared the motion carried.

 

9.  Mayor Calhoun presented the following departmental reports:  Community Center, Fire, Police & Animal Control, Library, Court, and Building Department.

 

10.  Mayor Calhoun presented an application by Corner Stop & Save, L.L.C.,  (located at 2069 Sutton Bridge Road) purchased by the Beer Store, Inc., for a transfer of retail beer, off premises only.   Jeff Overstreet moved and Lloyd Matthews seconded the motion to grant the transfer.   Mayor Calhoun declared the motion carried.

 

11.  Mayor Calhoun announced that Judge Jay Stover recommended that Judicial Correction Services, Inc., serve as the private probation company to work with our court system.  This will not cost the city any money.  If the fine is paid in seven (7) days it will not cost the person paying anything, but on the 8th day it will cost them an extra $35.00.  This will be paid to the probation service.  This service collects fines for the City of Southside and Attalla.   Bryan Stone moved and Lloyd Matthews seconded the motion to use this company for the collection of fines.  Mayor Calhoun declared the motion carried.

 

12.   Mayor Calhoun presented the following travel\tuition:

          Sgt. Greg Carroll to attend the 2005 PCRIA Training Conference in Birmingham, June 19-21, 2005, at a cost of $99.00 for registration, plus hotel accommodations for two nights.

          Assistant Chief Kevin Conklin to attend NIMS Train the Trainer, July 6-7, 2005 at the Alabama Fire College, Tuscaloosa.   The cost of the class is $25.00.  Total cost for food, registration and lodging is $120.00.

          Barbara Wester, City Clerk to attend Clerk’s Day in Mobile, July 22-23, 2005.  Registration is $75.00 plus lodging.  Also, certification training at the University of Alabama, Tuscaloosa, August 3-5, 2005. 

          Cheryl Ayres to attend the Alabama Municipal Revenue Officers Annual Conference to be held August 15-17, 2005 in Orange Beach.  Registration is $275.00.    Lloyd Matthews moved and Jeff Overstreet seconded the motion to grant the travel\tuition.

 

13.  Mayor Calhoun presented an ad in the amount of $60.00 from the Woman’s Club.  Bryan Stone made a motion to purchase the ad.  The motion died for lack of a second.

 

14. Mayor Calhoun announced that bids will be received by the city until June 27, 2005 at 2:00 P. M. to purchase a LaserJet 4350DTN printer and Okidata Laser-4350N printer.  These printers will be used in the revenue department and payroll and accounting department.   Jeff Overstreet moved and Bryan Stone seconded the motion to post the bids and open them at 2:00 P. M. June 27, 2005.   Mayor Calhoun declared the motion carried.

15.  Lloyd Matthews announced that the Street and Sanitation Department was

having problems with their equipment.  The bush hog caught on fire today, and the garbage truck broke down.  

 

16.  Jeff Harwood, Police Chief read and presented letters of commendation to 

Lt. Rick Hill, and Officers Scott Holderfield and Thomas Spurling for their work in the early morning hours of June 8, 2005 for the arrest of persons involved in the break-in of Southtown Mini Storage warehouses located at 199 Woodland Drive.

The arrests of these persons by the officers led to additional arrests of other involved persons by the Rainbow City Detective Division later in the morning of June 8, 2005.  The arrest led to the seizure of property that had been taken from over eighty burglaries occurring in Rainbow City within the past three months.  It also led to the solving of the burglary which occurred at Sonic restaurant on Rainbow Drive in April 2005 where over six thousand dollars was stolen.  These cases were open cases that were under investigation and solved by Detectives Greg Carroll and Tommy Watts of the Detective Division.   Mayor Calhoun spoke on behalf of the City Council and thanked the officers again for the great job they did.

 

There being no further business to come before the Council at this time, Bryan Stone made a motion to adjourn.
