STATE OF
CITY OF
The City Council of the City of Rainbow City, Alabama, met
in regular session at City Hall at 6:30 P.M., and upon roll call by the City Clerk,
Barbara T. Wester, the following members answered present:
Terry John Calhoun, Mayor
Council members:
Jeff Overstreet
Bobby McCartney
Lloyd Matthews
Bryan Stone
Kris Cornutt
The same constituting a quorum of the City Council, the following
business was transacted.
1. The meeting was
called to order by Terry John Calhoun.
2. Invocation was
given by Bryan Stone.
3. Mayor Calhoun led
the Pledge of Allegiance to the flag.
4. Mayor Calhoun
presented the minutes of September 26,
2005 for review, and asked if there were any corrections, additions, or
deletions. There being none, Jeff
Overstreet moved and Bryan Stone seconded the motion to approve the minutes as
presented. Mayor Calhoun declared the
motion carried.
5. Mayor Calhoun
announced that bids were opened today at 11:00 a.m. in the council chambers for
the 2005 Street Resurfacing Project.
Two bids were received: (1) Good
Hope Contracting had a bid of $128,960.00 and (2) McCartney Construction
Company had a bid of $128,262.50.
Lloyd Matthews moved and Bryan Stone seconded the motion to accept the
low bid. Mayor Calhoun declared the
motion carried.
6. Mayor Calhoun
announced that a public hearing was being held concerning Ordinance No.
428. He reported that residential
garbage would increase to $l0.00 per month for a container not less than ten or
more than thirty (30 gallons. If the
resident has a garbage can in excess of thirty (30) gallons, the garbage will
have to be bagged and placed in the container.
The charge for a business will be $20.00 per month for four (4), forty
gallon containers, and needs to be bagged.
Bryan Stone made a motion to introduce the ordinance. Bobby McCartney moved and Jeff Overstreet
seconded the motion to suspend the rules for immediate consideration. Mayor Calhoun asked for a roll call vote as

Mayor Calhoun declared the motion carried.
7. Bryan Stone moved
and Jeff Overstreet seconded the motion to adopt Ordinance No. 428. Mayor Calhoun asked for a roll call vote as

Mayor Calhoun declared the motion carried.
8. Mayor Calhoun
presented the Budget for 2005-2006. He
also informed the council that all grant money would be spent on what the grant
calls for. Bryan Stone moved and Jeff
Overstreet seconded the motion to adopt the budget. Mayor Calhoun declared the motion carried.
9. Mayor Calhoun
presented the following departmental reports:
Building, Fire & Rescue, Police & Animal Control, Library, Court
and Community Center. He asked if anyone
had comments or questions. No one
responded.
10. Mayor Calhoun
asked that the minutes show that Firefighter/Paramedic Michael Garmany resigned effective September 28, 2005. Jeff Overstreet moved and Kris Cornutt seconded the motion to post the position October
11, 2005 to replace Mr. Garmany and close the posting
Friday, October 21, 2005 at 4:00 P. M.
Mayor Calhoun declared the motion carried.
11. Mayor Calhoun
presented a recommendation by Chief Ragan to hire Connie Gilbert as an on-call
(non-regular permanent) dispatcher at Range 23 Step 17. Jeff Overstreet moved and Kris Cornutt seconded the motion to hire Ms. Gilbert. Mayor Calhoun declared the motion carried.
12. Mayor Calhoun
announced that the Etowah County Tag Office will open Wednesday, October 12,
2005. The hours are 8:00 a.m. to 4:00
p.m., with lunch from 12:00 p.m. to 1:00 p. m. Kelly Nail in the tag office can be reached
at 413-7056.
13. Mayor Calhoun presented
an ad request from the Chamber for a ¼ page ad for $450.00 for the 2005
Membership Directory. Bryan Stone moved
and Jeff Overstreet seconded the motion to purchase the ad. Mayor Calhoun declared the motion carried.
14. Lloyd Matthews
stated that the street paving will start in approximately three (3) weeks, if
the weather remains good. Lloyd moved
and Bryan Stone seconded the motion to make Greg Payne, Street and Sanitation
Supervisor, with a rate of pay of $40,000.00 per year effective
immediately. Mayor Calhoun declared the
motion carried.
15. Kris Cornutt thanked Eddie and the Parks and Recreation
Department for assisting in passing out the trash schedule.
16. Bryan Stone
congratulated Greg Payne for the great job he is doing in the Street and
Sanitation Department.
17. Harvey Coleman
appeared before the council concerning drainage problems at West Minister. Lloyd Matthews stated that the City Engineer
and Building Official met with the

There being no further business to come before the council
at this time, Bryan Stone made a motion to adjourn.
