The City Council of the City of Rainbow City, Alabama, met in regular session at City Hall at 6:30 P.M., and upon roll call by the City Clerk, Barbara T. Wester, the following members answered present:

The same constituting a quorum of the City Council, the following business was transacted.
1. The meeting was called to order by Mayor Calhoun.
2. Invocation was given by Lloyd Matthews.
3. Mayor Calhoun led the pledge of allegiance to the flag.

5. Mayor Calhoun presented the minutes of October 9, 2006 and October 13, 2006 for review and asked if there were any corrections, additions, or deletions. There being none, Bobby McCartney moved and Bryan Stone seconded the motion to approve the minutes as presented. Mayor Calhoun declared the motion carried.
6. Mayor Calhoun asked Jeff Overstreet to report on the hiring of a police officer. Jeff stated that at the last council meeting it was recommended that the job be reposted, due to no applications being turned in. Jeff moved and Bryan Stone seconded the motion to hire John Hall, who works for Blountsville, and the hiring date will be determined by his giving his notice. Discussion followed. Lloyd Matthews made a motion to table the hiring. There was no second. Motion Died. Discussion followed. Jeff amended his motion to hire the officer and check with the insurance about the liability of the canine dog. Discussion followed. Kris Cornutt moved and Lloyd Matthews seconded the motion to table the hiring, until the insurance company could be contacted. Mayor Calhoun asked for a roll call vote:

7. Mayor Calhoun stated that bids were opened at 6:00 P. M. for the cleaning of the library and community center. Three (3) bids were received: (l) Hanson Cleaning--$1880.00, (2) Minyard Cleaning--$1800.00, and (3) Keller Meyer Cleaning--$1850.00. Bryan Stone moved and Lloyd Matthews seconded the motion to award the bid to the low bidder, Minyard Cleaning. Mayor Calhoun declared the motion carried.
8. Mayor Calhoun stated that bids were opened for the air compressor for the fire department. Two (2) bids were received: (1) B & T Enterprise--$49,352.00 and alternative bid of $45,988.00, and (2) Sunbelt Fire--$49,650.00. Mayor Calhoun also stated that we have a grant of a little over $43,000.00 to pay for this. He asked the Fire Chief to go over the specs. Jeff Overstreet moved and Lloyd Matthews seconded the motion to award the low bid, subject to meeting specs. Mayor Calhoun declared the motion carried.
9. Mayor Calhoun announced that
a public hearing is being held concerning Ordinance #437, the rezoning of the
property of Rainbow Plaza Association, LTD., located at
Michelle Boatwright spoke concerning the rezoning. Discussion followed. Lloyd Matthews made a motion to introduce the ordinance. Bryan Stone moved and Lloyd Matthews seconded the motion to suspend the rules for immediate consideration. Mayor Calhoun asked for a roll call vote as follows:

The motion did not carry. It will be voted on again at the next council meeting.
10. Mayor Calhoun stated that a public hearing was being held concerning Resolution No. 06-09, the deannexation of the property of Michael White in Whorton Bend, consisting of 17.71 acres, and asked if anyone had comments. There were none.
Kris Cornutt moved and Bryan Stone seconded the motion to adopt the resolution. Mayor Calhoun declared the motion carried.
11. Mayor Calhoun presented Resolution No. 06-10, and stated that the city is appointing Regions Bank as depository, paying agent and transfer and authenticating agent to handle the cities General Obligation Series 2002 Warrants, and authorizes the City Clerk to take any and all actions that may be required in order to perform in the name of the City such actions and to execute, deliver, seal, attest and accept such documents and certificates to carry out fully the appointment authorized by this resolution. Mayor Calhoun also stated that Frank Caley handled this warrant when he worked with Southtrust Bank. This transfer will save the city $250.00 per year. The warrant will payoff in 30 payments.
12. Mayor Calhoun asked that the records show that he appointed Judson Hamilton to serve as Chairman of the Board of Adjustment in the absence of Richard Gilbert, who is sick.
13. Mayor Calhoun presented a list of items that the library asked to be declared as surplus and put on govdeals.com. Kris Cornutt moved and Lloyd Matthews seconded the motion to declare these items as surplus. Mayor Calhoun declared the motion carried.
14. Mayor Calhoun presented a list of items that the accounting department asked to be declared as surplus and put on govdeals.com. Kris Cornutt moved and Lloyd Matthews seconded the motion to declare these items surplus. Mayor Calhoun declared the motion carried.
15. Mayor Calhoun presented a request from the Southside Tip-Off Club for a sign in the gym for $50.00. This is a renewal. Bryan Stone moved and Bobby McCartney seconded the motion to purchase the sign. Mayor Calhoun declared the motion carried.
16. Mayor Calhoun presented a
request for Mr. John Watson, Mr. Thomas Moon, and Mr. Bryan Stone to attend the
AARC 2006 Conference held in
17. Mayor Calhoun presented Proclamation no. 06-05 declaring November 11, 2006 as Veteran’s Day and November 9-11, as National Veteran’s Awareness Week. Kris Cornutt moved and Lloyd Matthews seconded the motion to adopt the proclamation. Mayor Calhoun declared the motion carried.
18. Mayor Calhoun presented Proclamation no. 06-06, declaring November 2006 as National America Indian Heritage Month, and asks that all Americans learn more about the history and heritage of the Native peoples of this great land.
19. Lloyd Matthews stated that Street Department is getting behind on the grass cutting, but the person cutting the grass has been in the hospital.
20. Jeff Overstreet moved and Lloyd Matthews seconded the motion to promote Tim Crowe to Assistant Fire Chief at the rate of pay for this position. Mayor Calhoun declared the motion carried.
21. Jeff Overstreet moved and Lloyd Matthews seconded the motion to promote Wade Buckner to Captain with no pay increase, because he is already making Captain pay. Mayor Calhoun declared the motion carried.
22. Jeff Overstreet moved and Bryan Stone seconded the motion to put Captain Rick Hill on salary at $45,000.00 per year, and he will be able to accumulate compensation time. Mayor Calhoun declared the motion carried.
23. Jeff Overstreet moved and Lloyd Matthews seconded the motion to increase the salary of Chief Melvin Potter $2500.00 per year, because he is also filling the position of Fire Marshall. Mayor Calhoun declared the motion carried.
24. Jeff Overstreet moved and Lloyd Matthews seconded the motion to give Justin Zemo a 6-month pay increase of $.50 per hour, making his total pay $12.11 per hour. Mayor Calhoun declared the motion carried.
25. Jeff Overstreet announced that both fire trucks have arrived.
26. Mayor Calhoun stated that they will start putting the lights on the ball fields next month. He also thanked the Utility Board for running 6-inch water lines to the new complex.
There being no further business to come before the council at this time, Kris Cornutt made a motion to adjourn.
