CITY OF RAINBOW CITY-COUNCIL MEETING-OCTOBER 29, 2007

 

The City Council of the City of Rainbow City, Alabama, met in regular session at City Hall at 6:30 p.m., and upon roll call by the City Clerk, Barbara T. Wester, the following members answered present:

 

Terry John Calhoun, Mayor

 

Council members:

The same constituting a quorum of the City Council, the following business was transacted.

 

1.  The meeting was called to order by Mayor Calhoun.

 

2.  Invocation was given by Bryan Stone.

 

3.  Mayor Calhoun led the Pledge of Allegiance to the flag.

 

4.  Mayor Calhoun presented the minutes of October 8, 2007 for review and asked if there were any corrections, additions, or deletions.  There being none, Bryan Stone moved and Cora Kelly seconded the motion to approve the minutes as presented.  Mayor Calhoun declared the motion carried.

 

5.  Mayor Calhoun presented Blaine Galliher, House of Representatives, District 30.  Representative Galliher stated he was glad to be here on behalf of Larry Means, and the other members of the Etowah County Community Development Committee.  He stated the committee met and distributed taxpayer’s money from Etowah County.  They allocated $50,000.00 to go toward the Recreation Department Concession Stand.  He also stated that $2,000.00 was given to the seniors to purchase table and chairs; $3,000.00 to the Coosa Baseball Association to purchase equipment; $2,000.00 to the Soccer Association, and $15,000.00 to the library.   He stated that $l0,000.00 is given yearly to each volunteer fire department.  He applauded the council for building the athletic fields, because of their importance to the children.  He thanked everyone for allowing him to serve the City.  Mayor Calhoun thanked Blaine and Larry for working with the City the way they do.  Bobby McCartney also thanked Blaine for all his help.

 

6.  Mayor Calhoun asked that the records show that bids were opened last Thursday, October 25, 2007, for the concession and scorer’s tower for the Vivian Lee Maddox Sports Complex.  B.D. Welch Construction Company submitted the low bid, and negotiations are being held at the present time to lower the bid to a figure the city can work with.

 

7.    Mayor Calhoun presented Proclamation No. 07-06, declaring the month of November as Adoption Awareness Month.   Bryan Stone moved and Kris Cornutt seconded the motion to adopt the proclamation.   Mayor Calhoun declared the motion carried.

 

8.  Mayor Calhoun presented Ordinance No. 455, Storm Water Management Regulations.  Lloyd Matthews made a motion to introduce the ordinance.  Kris Cornutt moved and Cora Kelly seconded the motion to suspend the rules for immediate consideration.  Mayor Calhoun asked for a roll call vote as follows:

Mayor Calhoun declared the motion carried.    He asked if anyone had any questions concerning the ordinance, for or against it.  There were no comments.

 

9.  Bryan Stone moved and Lloyd Matthews seconded the motion to adopt Ordinance No. 455.   Mayor Calhoun asked for a roll call vote as follows:

Mayor Calhoun declared the motion carried.

 

10.  Mayor Calhoun presented Ordinance No. 456, granting a franchise to Alabama Gas Corporation.  Lloyd Matthews made a motion to introduce the ordinance.  Kris Cornutt moved and Bryan Stone seconded the motion to suspend the rules for immediate consideration.  Mayor Calhoun asked for a roll call vote as follows:

11.  Cora Kelly moved and Lloyd Matthews seconded the motion to adopt Ordinance No. 456.   Mayor Calhoun asked for a roll call vote as follows:

Mayor Calhoun declared the motion carried.

 

12.  Mayor Calhoun presented a request from Rainbow City Pediatrics to change the name of the road from Baptist Health Center Drive to Kid’s Way.  Lloyd Matthews moved and Kris Cornutt seconded the motion to change the name.   Mayor Calhoun declared the motion carried.

 

13.  Mayor Calhoun presented a statement from M & M Express to pressure wash and clean the parking lot side walk and curb in front and the side of the municipal building, and also to clean the concrete around the light pole and concrete around the flag pole for $375.00.   Kris Cornutt moved and Bryan Stone seconded the motion to approve the statement.   Mayor Calhoun declared the motion carried.

 

14.  Mayor Calhoun presented a request from Rainbow Middle School to place an advertising sign (3 X 5) in the gym for $200.00.  Lloyd Matthews moved and Cora Kelly seconded the motion to purchase the sign.   Mayor Calhoun declared the motion carried.

15.  Chief Ragan addressed the Council concerning the speed limit at the junction of Hwy 77 and 411.   He stated a letter was sent January 12, 2007 to the State concerning changing the speed limit to 35 mph.  He stated he received no response. He spoke to Craig Ford and he sent a letter to the State on September 14, 2007.  He received a letter on October 9, 2007 that stated the State did a study, and it did not warrant changing the speed limit to 35 mph.   Mayor Calhoun stated he called Blaine Galliher and Larry Means and they were unable to get the speed limit changed.   Discussion followed.

 

16.  Mayor Calhoun presented a request from Chief Ragan to post the position of police dispatcher to replace Vicki Griffin who resigned Friday, October 26, 2007.   Cora Kelly moved and Bobby McCartney seconded the motion to post the position until November 7, 2007 at 2:00 p.m.   Mayor Calhoun declared the motion carried.

 

17.  Mayor Calhoun announced that the next council meeting will be Thursday, November 8, 2007 at 8:00 a.m., due to the Veterans Day Holiday of November 12, 2007.

 

18.  Mayor Calhoun stated that the roofs and bathroom at Rainbow Landing needed to be replaced.  Eddie Cline, Recreation Director received several quotes.  Bobby McCartney moved and Cora Kelly seconded the motion to let Rainbow Pipe & Metal, LLC, make the repairs for a total cost of $5,973.04.   Mayor Calhoun declared the motion carried.

 

19.  Mayor Calhoun presented a request from Shahinur Nahar dba Fuel Depot, (located at 3101 Rainbow Drive) for Retail Table Wine (Off Premises Only) and Retail Beer (Off Premises Only) license.   Bryan Stone moved and Lloyd Matthews seconded the motion to approve the license.   Mayor Calhoun declared the motion carried.

 

20.  Lloyd Matthews stated he would like to see a training facility for the police and fire department.    Mayor Calhoun stated he agreed, and maybe one could be established in the future with the purchase of the Chert pit.   Discussion followed.

 

21.  Kris Cornutt stated that Mary Couch has been serving on the Library Board and her term expired October 6, 2007.  Tina Brooks, Librarian recommended her for another term of four (4) years.    Kris moved and Lloyd Matthews seconded the motion to appoint her to another term.   Mayor Calhoun declared the motion carried.   Kris also stated that thanks to Blaine Galliher, the library receives $l5, 000.00 annually from the one cent sales tax, and this year the library is receiving a one-time check in the amount of $l0, 000.00.   He stated he would like to thank all the board members.   He stated the budget for the library needs to be amended in the amount of $l0, 000.00.  He moved and Lloyd Matthews seconded the motion to amend the budget as follows:  Supplies, $3,000.00; Equipment & Tools, $l600.00; Summer Reading, $1200.00; Repairs and Maintaince, $2,000.00; Books, $l200.00; Audio/Video, $1,000.00.   Mayor Calhoun declared the motion carried.  Kris stated he would also like to thank Tina and her staff for the good job they do.

 

22.  Cora Kelly moved and Bryan Stone seconded the motion to increase Jeremy Hawkins’s salary to $12.11 per hour for completion of one year as firefighter/paramedic.

Mayor Calhoun declared the motion carried.

 

23.  Bobby McCartney stated that the annual Christmas Tree Lighting will be Tuesday, December 4, 2007 at 6:00 p.m.  Area churches will have their children participating in the choirs.  Strut USA will entertain at the Community Center and hot dogs will be furnished and served by the Lions Club.

 

24.  Chief Ragan requested that the speed limit be changed to 15 MPH at Montrose Gardens.   Lloyd Matthews moved and Cora Kelly seconded the motion to change the speed limit.   Mayor Calhoun declared the motion carried.
