The City Council of the City of Rainbow City, Alabama, met in regular session at City Hall at 6:30 P. M., and upon roll call by the City Clerk, Barbara T. Wester, the following members answered present:

The same constituting a quorum of the City Council, the following business was transacted.
1. The meeting was called to order by Mayor Terry John Calhoun.
2. Invocation was given by Bobby McCartney.
3. Mayor Calhoun led the pledge of allegiance to the flag.
4. Mayor Calhoun presented the minutes of October 24, 2005 and special called meeting of November 2, 2005 for review, and asked if there were any corrections, additions, or deletions. There being none, Kris Cornutt moved and Bryan Stone seconded the motion to approve the minutes as presented.
5. Mayor Calhoun
stated a public hearing was being held concerning Ordinance No. 430, the
annexation of the property of Kevin Matthews,

Mayor Calhoun declared the motion carried.
6. Jeff Overstreet moved and Bobby McCartney seconded the motion to adopt Ordinance No. 430. Mayor Calhoun asked for a roll call vote as follows:

Mayor Calhoun declared the motion carried.
7. Mayor Calhoun asked the council to allow him to sign an Oil, Gas, and Mineral Lease with Energen Resources Corporation for five (5) years. The city will be paid

$l00.00 per acre. The city has l0.5 acres and the property is located near Pioneer (Maddox Property). Kris Cornutt moved and Lloyd Matthews seconded the motion to grant the mayor the authority to sign the contract. Mayor Calhoun declared the motion carried.
8. Mayor Calhoun presented a Vehicle Use Policy that was recommended by Alabama Municipal Insurance Corporation. Jeff Overstreet moved and Bryan Stone seconded the motion to adopt this policy. Mayor Calhoun declared the motion carried.
9. Mayor Calhoun
presented a letter of resignation from Charles Clifton, effective November 27,
2005. Mayor Calhoun stated he hated to
loose Sgt. Clifton, but he had been offered a Commander Position with
10. Mayor Calhoun presented the following monthly reports: Library, Community Center, Fire and Rescue, Police & Animal Control, Court and Building.
11. Mayor Calhoun presented the following equipment from the Police Department to be declared as surplus: Xerox copier, model no. 5820, serial no. N9N084678. Jeff Overstreet moved and Bryan Stone seconded the motion to declare this property as surplus. Mayor Calhoun declared the motion carried.
12. Mayor Calhoun presented the following vehicles to be declared as surplus from the Recreation Department: one (l) 1988 Dodge Dakota pickup, white, serial #4936 and one (l) 1984 Chevrolet 4X4 pickup, red and white, serial #8043. Bryan Stone moved and Bobby McCartney seconded the motion to declare this property as surplus. Mayor Calhoun declared the motion carried.
13. Mayor Calhoun presented the following vehicles and equipment to be declared as surplus from the Street Department: one (l) 1987 Chevrolet C-10, serial #6318, one (l) 1970 Ford F-800, serial #3384, and a Ray Go Rascal 320-A, serial #37A120. Bryan Stone moved and Kris Cornutt seconded the motion to declare this property as surplus. Mayor Calhoun declared the motion carried.
14. Bryan Stone moved and Bobby McCartney seconded the motion to open bids on the surplus equipment in the Recreation Department, vehicles in the Police Department, and vehicles and equipment in the Street Department, November 23, 2005 at 9:00 A. M. Mayor Calhoun declared the motion carried.
15. Mayor Calhoun presented a request from Melvin Potter, Fire Chief to purchase a 2000 International 4700 series truck for $7,498.00. This will be used as a Service\Squad unit and would contain equipment for hazardous materials and special operations. Further plans for this unit include a mounted light tower for scene lighting and a mounted air compressor to allow for filling of air bottles on the scene of a fire or other incident. Mr. Kirk Mabeus, owner of the local Interstate Battery Distributor has offered this truck to the department. Bobby McCartney moved and Kris Cornutt seconded the motion to purchase the truck. Mayor Calhoun declared the motion carried.
16. Mayor Calhoun presented the following travel\tuition:

17. Mayor Calhoun presented an ad request from Danny Lee, WGAD for the City to purchase ten (10) ads for 30 seconds each for $l69.50. No action was taken.

18. Mayor Calhoun announced that the Christmas Tree Lighting will be Tuesday, November 29, 2005 at 6:00 P. M. in front of City Hall. If it rains everything will be held at the Community Center. He also announced that the Lions Club will be selling pecans, walnuts, and other nuts here at City Hall in the Revenue Office.
19. Lloyd Matthews announced that ADEM came in about two (2) weeks ago and gave the City two (2) weeks to clean up and haul off everything at the trash location. Everything is on hold now for trash pickup, but the city is working on plans for future pickup. There
will be a meeting Thursday,
November 17, 2005 to determine if the cleanup passes inspection. He also discussed a four-way stop sign at
20. Kris Cornutt thanked Greg Payne for all the work done at the Pioneer site and the citizens for their patience. He stated that the librarian, Tina Brooks hired Dorothea Byers as a replacement (non-regular-permanent) for Helen Hoffman at a starting rate of $5.50 per hour.
21. Mayor Calhoun stated he backed up what Lloyd and Kris said, and stated the City cannot pick up trash again until we get an o.k. from ADEM. He also thanked Kathy Roe, Gadsden Times for the article in the paper concerning this problem.
22. Jeff Overstreet thanked the fire department for putting up the Christmas lights and for locating the angels (lights) at the cross roads. He also stated that the Chief, Allan Ragan had recommended hiring two (2) police officers, Andrew Stanly and Nicholas Gaskin at Range 25 Step 17. Jeff moved and Lloyd Matthews seconded the motion to hire the two officers. The officers were hired by unanimous vote, with the exception of Bryan Stone who abstained.
23. Bobby McCartney stated that the Maddox property looks great. He thanked the Street and Recreation Department who has been working together on this property. He stated that everything at the Community Center was running smoothly. The center will be closed December 24-27, 2005 to wax and finish the floors.
24. Mayor Calhoun thanked all the employees and Department heads for the good job they are doing. He also asked that all departments have their inventory turned in by November 15, 2005.
Their being no further business to come before the council at this time, Bryan Stone made a motion to adjourn.
