CITY OF RAINBOW CITY-COUNCIL MEETING-DECEMBER 11, 2006

 

The City Council of the City of Rainbow City, Alabama, met in regular session at City Hall at 6:30 P.M., and upon roll call by the City Clerk, Barbara T. Wester, the following members answered present:

 

Terry John Calhoun, Mayor

 

Council members:

 

Cora Kelly

Bobby McCartney

Lloyd Matthews

Bryan Stone

Kris Cornutt

 

The same constituting a quorum of the City Council, the following business was transacted.

 

1.  The meeting was called to order by Mayor Calhoun.

 

2.  Invocation was given by Bobby McCartney.

 

3.  Mayor Calhoun led the Pledge of Allegiance to the flag.

 

4.  Mayor Calhoun presented the minutes of December 11, 2006 for review and asked if there were any corrections, additions or deletions.  There being none, Bryan Stone moved and Kris Cornutt seconded the motion to approve the minutes as presented.   Mayor Calhoun declared the motion carried.

 

5.  Mayor Calhoun stated a public hearing is being held to present a recommendation from the Planning Commission stating that the item on the preliminary plat submitted for review/approval, be amended to include an additional subsection as follows:

            (16)  The proposed size/dimensions of the driveway drainage pipe for each lot be shown on the plat, and that Section 314 of the Zoning Ordinance No. 360 be amended to include the same requirement for all site plans submitted to the city for review.  This recommendation also came from the Building Department.    Bryan Stone moved and Bobby McCartney seconded the motion to add this section to the zoning ordinance.  Mayor Calhoun asked for a roll call vote:

Mayor Calhoun declared the motion carried.

 

6.  Mayor Calhoun stated that a public hearing is being held concerning Ordinance No. 443, an ordinance to adopt various standard codes related to inspection activities of the city, and enforcement of building provisions as provided in said codes by amending any and all previous ordinances.   Bryan Stone made a motion to introduce Ordinance No. 443.   Kris Cornutt moved and Cora Kelly seconded the motion to suspend the rules for immediate consideration.  Mayor Calhoun asked for a roll call vote as follows:

Mayor Calhoun declared the motion carried.

 

7.  Kris Cornutt moved and Bryan Stone seconded the motion to adopt Ordinance No. 443.  Mayor Calhoun asked for a roll call vote as follows:

Mayor Calhoun declared the motion carried.

 

8.  Mayor Calhoun presented Resolution No. 06-16, authorizing the Mayor to enter into a contract between the City of Rainbow City and the Alabama Municipal Clerks and Administrators.  This contract is to provide education and support services to Municipal Clerks in the execution of their duties, and to advertise and promote the City of Rainbow City.  This is to make a sponsorship donation to the IIMC Region III Meeting in January.

The Alabama Clerks are in charge of this meeting.   Lloyd Matthews moved and Cora Kelly seconded the motion to adopt this resolution.   Mayor Calhoun declared the motion carried.

 

9.  Mayor Calhoun presented a resolution from Richard Wade Traylor DBA Mavericks to sell Retail Beer/Off Premises only.  (Located at 3815 Rainbow Drive).   Lloyd Matthews moved and Bryan Stone seconded the motion to approve this application.   Mayor Calhoun declared the motion carried.

 

10.  Mayor Calhoun announced that garbage pickup for the Christmas holidays and New Year’s Day will be one day late.  Pickup will be Tuesday through Saturday.

 

11.  Mayor Calhoun presented a recommendation from the Police Department to change the speed limit at the intersection of Hwy 77 and 411.  Chief Ragan spoke concerning this change.  He stated this is the largest and busiest intersections in the county, and considering the amount of traffic and the size of the intersection, he recommended the speed limit be lowered to 35mph.  He stated this lower speed should give all vehicles, (particularly large trucks), more stopping time.   Bryan Stone moved and Cora Kelly seconded the motion to make the recommendation to the State to change the speed limit to 35 mph.   Mayor Calhoun declared the motion carried.

 

12.  Mayor Calhoun asked that the records show that the following reports were presented:  Library, Court, Community Center, Police and Animal Control, Building and Fire Department.

 

13.  Mayor Calhoun presented a request from the Messenger for ˝ page ad for $l60.00.  Bryan Stone moved and Lloyd Matthews seconded the motion to purchase this ad.  Mayor Calhoun declared the motion carried.

 

14.  Bruce Williams of the Rainbow City and Southside Soccer League appeared before the council to thank the city for all its support.  He stated there are 400 kids consisting of 54 teams and 9 traveling teams.    Mayor Calhoun thanked Mr. Williams for coming to council and told him it was a pleasure working with him.   Lloyd Matthews stated he admired Mr. Williams because he has worked with the kids in the past.

 

15.  Mayor Calhoun announced that the next council meeting will be January 8, 2007.

16.  Mayor Calhoun stated that Jack Rutledge, Gadsden Water Works, Rainbow City’s city attorney and Gadsden’s attorney were at the Rainbow City Utility Board Meeting recently.  Discussion was held concerning Rainbow City’s tie in to Gadsden’s sewer.

ADEM is requiring changes in the near future for Rainbow City, and Gadsden is building a county wide sewer treatment plant.  The cost is around $l0,000,000.00.  Mayor Calhoun asked the council if the city could continue talking with Gadsden about the new treatment plant.  Gadsden will handle everything concerning the plant.  Rainbow City does not have any property to build a plant on.  Rainbow City will only pay for what we discharge.  The city will not have to pay for what we do not use.    Lloyd Matthews moved and Bryan Stone seconded the motion for the council to continue pursuing a sewer tie in with Gadsden.    Mayor Calhoun declared the motion carried.

 

17.  Cora Kelly stated that the following fireman:   Nick Hill, Chris Hawkins and Scott Richardson graduated from Rookie School December 6, 2006.

 

18.  Kris Cornutt wished everyone a “Merry Christmas.”    Bryan Stone stated he echoed Kris’s comments.

 

19.  Chief Ragan requested that the funds the department received from the police calendar be used to purchase four (4) Window Tint Meters.   They should receive around $740.00.    Cora Kelly moved and Bobby McCartney seconded the motion to designate these funds to purchase these meters at $l98.00 a piece, and to amend the budget to show this money is going toward the purchase of these meters.   Mayor Calhoun declared the motion carried.   Cora also wished everyone a “Merry Christmas,” and stated that she was glad to be back on the council.

 

20.   Bobby McCartney stated that this is a busy time of the year for the Recreation Department and Community Center.  He thanked Eddie Cline for the good job he is doing.  He stated the lights are up at Pioneer and they are getting ready for the disc golf course to be laid out. 

 

There being no further business to come before the council at this time, Bryan Stone made a motion to adjourn.
