CITY OF RAINBOW CITY—COUNCIL MEETING—SEPTEMBER 12, 2005

 

The City Council of the City of Rainbow City, Alabama, met in regular session at City Hall at 6:30 P. M., and upon roll call the following members were present:

The same constituting a quorum of the city council, the following business was transacted.

 

1.  The meeting was called to order by Mayor Terry John Calhoun.

 

2.  Invocation was given by Kris Cornutt.

 

3.  Mayor Calhoun led the pledge of allegiance to the flag.

 

4.   Mayor Calhoun presented the minutes of August 22, 2005 for review, and asked if there were any corrections or additions.  There being none, Bryan Stone moved and Kris Cornutt seconded the motion to approve the minutes as presented.  Mayor Calhoun declared the motion carried.

 

5.   Mayor Calhoun announced that he would like to thank the churches, clubs, employees, Lloyd Matthews, Ken Roarke, and Doyle Hill of the Lions Club for feeding the hurricane evacuatees.

 

6.  Mayor Calhoun announced that Jeff Overstreet had a recommendation for fire chief. Jeff moved and Lloyd Matthews seconded the motion to appoint Melvin Potter as fire chief.   Mayor Calhoun asked for a roll call vote:

Mayor Calhoun declared the motion carried.

 

7.  Mayor Calhoun announced that the clerk opened bids for the 1998 Ford Crown Victoria, serial no 3634.    Two (2) bids were received.  They are as follows:  Jessie Allen, $512.00, Steve Khader, $2010.00.  Bobby McCartney moved and Kris Cornutt seconded the motion to accept the high bid.   Mayor Calhoun declared the motion carried.

 

8.  Mayor Calhoun announced that a public hearing was being held concerning Ordinance No. 427, for the rezoning of property behind the old Foodworld building.  Mayor Calhoun asked if there was anyone present to speak for or against the ordinance.  Marty Campbell spoke in opposition to the ordinance.  No one else spoke.  Bryan Stone made a motion to introduce the ordinance.  Jeff Overstreet moved and Bobby McCartney seconded the motion to suspend the rules for immediate consideration.  Mayor Calhoun asked for a roll call vote as follows:

9.  Mayor Calhoun asked for a motion to adopt the ordinance.    No motion was made.   Died for lack of a motion. 

 

10.  Mayor Calhoun presented a recommendation from the Street & Sanitation Supervisor to declare the following property as surplus and take bids until September 26, 2005 at 2:00 p.m.

                                    1993-6640 Ford tractor, serial no. BD4776, model EA-5PBR

1990 Dodge one-ton dump truck, serial no. 9328

Lloyd Matthews moved and Kris Cornutt seconded the motion to declare this property as surplus and  accept bids until September 26, 2005 at 2:00 p.m.    Mayor Calhoun declared the motion carried.

 

11.  Mayor Calhoun presented Resolution No. 05-09, for the adoption of the National Incident Management System (NIMS) as the basis for all incident management within the city.  The NIMS standardized procedures are for managing personnel, communications, facilities, and resources and will improve the state’s ability to utilize federal funding to enhance local and state agency readiness, maintain first responder safety, and streamline incident management processes.  Bobby McCartney moved and Lloyd Matthews seconded the motion to adopt the resolution.   Mayor Calhoun declared the motion carried.

 

12.  Mayor Calhoun presented Resolution No. 05-10 for the city to come under the provisions of Section 6 of Act 316 of the first special session of the 2005 Legislature.  Rainbow City agrees to provide all funds necessary to the employees’ Retirement System to cover the cost of the increases as provided by the Act for those eligible employees retired from the city, effective October 2005.   Bryan Stone moved and Bobby McCartney seconded the motion to adopt the resolution.   Mayor Calhoun declared the motion carried.

 

13.  Mayor Calhoun presented Resolution No. 05-11 to give him the authority to sign a Supplemental Agreement Number 2 with the State of Alabama, acting by and through the Alabama Department of Transportation amending an Agreement dated May 21, 1999, and Supplemental Agreement Number l, dated May 14, 2003, for the Construction Agreement, Project STPOA-8104, to extend Black Creek Parkway south to Steel Station Road, in the city.   Jeff Overstreet moved and Bryan Stone seconded the motion to adopt the resolution.   Mayor Calhoun declared the motion carried.

 

14.  Mayor Calhoun presented a revised sick leave policy, and asked that the policy become effective January 1, 2006.   He said he wanted to thank the employees who had helped with this revision, and that 90% of the employees were in favor of the change.

The new policy will allow city employees to use sick days and not have to wait and use personal days (three) before being able to use a sick day.  This policy will eliminate the

seven (7) personal days.  At the present employees can accrue up to 90 days of sick leave.  Now 120 days will be the maximum that can be accrued.   Bryan Stone moved and Kris Cornutt seconded the motion to approve the new sick leave policy.   Mayor Calhoun declared the motion carried.

 

15.  Mayor Calhoun presented the resignation of Jason Silvey, Recreation Department, effective September 2, 2005.   Kris Cornutt moved and Bryan Stone seconded the motion to accept the resignation.   Mayor Calhoun declared the motion carried.

 

16.  Mayor Calhoun presented a request from Southside volleyball, for ¼ page ad for $35.00.    Bobby McCartney moved and Kris Cornutt seconded the motion to grant the request.   Mayor Calhoun declared the motion carried.

 

17.  Mayor Calhoun presented the following departmental reports:  Fire and Rescue, Community Center, Library, Court, Police & Animal Control, and Building Department.

 

18.  Mayor Calhoun presented a request from Chief Ragan to allow Rick Hill to present a proposal from Northeast Alabama Emergency Vehicle Maintenance (NAEVM) for service of the police vehicles.   Jeff Overstreet moved and Lloyd Matthews seconded the motion for the presentation.  Officer Hill presented the presentation.  Discussion followed.   Jeff Overstreet moved and Lloyd Matthews seconded the motion for Northeast Alabama Emergency Vehicle Maintenance to service the police vehicles.  Mayor Calhoun declared the motion carried.

 

19.  Chief Ragan asked that the city reimburse the police department for the hotel fee for Kelly Smith to attend a recertification class at the Montgomery Police Academy, September 12-16, 2005 and September 19-23, 2005.   Jeff Overstreet moved and Lloyd Matthews seconded the motion to reimburse the police department.    Mayor Calhoun declared the motion carried.

 

20.  Mayor Calhoun presented the following travel\tuition, and asked if the council wanted to handle them one at a time.  Bobby McCartney moved and Kris Cornutt seconded the motion to handle one at a time.  Mayor Calhoun declared the motion carried. 

            Kaye Farley to attend the Alabama Municipal Court Clerks’ and Magistrates Certification and Training Institute, October 12-14, 2005 at the University of Alabama.

            Lloyd Matthews moved and Jeff Overstreet seconded the motion to grant the request.    Mayor Calhoun declared the motion carried.

            Dispatchers Marlene DiGangi and Missy Alford to attend the ACJIC Statewide Users Conference in Gulf Shore, October 11-13, 2005.  Lloyd Matthews moved and Jeff Overstreet seconded the motion to grant the request.    Mayor Calhoun declared the motion carried.

            John Watson, Thomas Moon, Wiley McLain, and Bryan Stone to attend the AARC Annual Training Conference at the Perdido Beach Resort in Orange Beach, October 16-19, 2005.   Jeff Overstreet moved and Lloyd Matthews seconded the motion to grant the request.   Mayor Calhoun declared the motion carried.

 

21. Mayor Calhoun read Proclamation No. 05-02, proclaiming October 9-15, 2005 as ”Fire Prevention Week.”    Jeff Overstreet moved and Bryan Stone seconded the motion to adopt this proclamation.

 

22.  Captain Larry Murray reported on the recent trip of Assistant Fire Chief Mac Buel and Firefighter\Paramedic Steve Tate to Gautier, Mississippi.  The fire department has adopted this fire department and will be sending others down to assist as needed.   The department has donated goods to the firefighters there, and manned trucks so they can go home.

23.   Lloyd Matthews reported that the county employees the city was contracting with to cut the grass on weekends are having problems, and hope to have this resolved as soon as possible.  He also thanked Ken Roark for his help delivering supplies to the hurricane victims after his wife was bitten by a copperhead and he was unable to make the trip.    Lloyd moved and Bryan Stone seconded a motion to stripe Palace Avenue at a cost of $.35 per foot, and contract with Freddie Knox

 to handle this.    Mayor Calhoun declared the motion carried.

 

24.  Kris Cornutt reminded everyone not to put their trash out until the week of pickup because snakes could get in the trash.  He reported that the new garbage truck is in and everything is running smoothly.  He also reminded everyone that September is library card sign-up month.   Kris reported that he had spoken with Westbrook School and the city can place a sign at the football stadium for $125.00.  Kris moved and Lloyd Matthews seconded the motion to purchase an ad for $125.00 from Westbrook “W” Club.   Mayor Calhoun declared the motion carried.

 

25.  Bryan Stone moved and Kris Cornutt seconded the motion to install a street light at the corner of Peteet and Betty Mae Street, pole number 101.  Mayor Calhoun declared the motion carried.    Bryan also commended the guys who work the garbage truck for the good job they are doing.  He also reported that he hoped the budget would be ready by  October l, 2005.  Revenues through July are down $568,000.00.  He stated that he gives each department head their budget to get together, and he gets an estimate of anticipated revenues from the Revenue Department for the previous year.   The estimated revenues for 2005-2006 is 6.5 million.  The city can only allocate 90% of this for the budget which is 5.8 million.  Bryan said he was returning each department’s budget to the council member over that department so they could give them to the department head to trim down, because they were over budget. 

 

26.  Jeff Overstreet commended the fire department for their success in the “Fill-the- Boot Campaign.”  The department collected $5,018.00 for the Muscular Dystrophy Association.  Jeff also reported on changes in life insurance that the clerks are taking out for employees for seven (7) companies by payroll deductions.  Discussion followed.

Jeff moved and Lloyd Matthews seconded the motion that at the end of the calendar year, January 31, 2006, the city will discontinue taking out life insurance premiums for employees, and will only take out city sponsored programs. The policy adopted by the council on July 11, 2005 is in effect until that time.   Mayor Calhoun declared the motion carried.   Jeff reported that the city will put out proposals for a company to offer a cafeteria plan for employees.   Mayor Calhoun appointed Lloyd Matthews, Kris Cornutt and Jeff Overstreet to come up with an insurance plan for the employees.

 

27.  Bobby McCartney reported that everything is running good in the Recreation Department and that the Director, Eddie Cline and his wife have a new baby boy.  He also said he would like to thank Jason Silvey for his service to the city.

 

There being no further business to come before the council at this time,  Kris Cornutt made a motion to adjourn.
