CITY OF RAINBOW CITY - BOARD OF ADJUSTMENTS – MAY 26, 2009

 

The Board of Adjustment of the City of Rainbow City, Alabama met in regular session at City Hall, and upon roll call the following members were present:

 

Judson Hamilton, Chairman                                           Absent:

Willard Hart                                                                 Robert Williams

James New

Kim Parker

J. R. Martin – supernumerary member                                                                          

                                                           

With a quorum being present, Mr. Judson Hamilton announced the start of the meeting. 

 

The minutes from October 21, 2008 and May 12, 2009 were presented.  James New moved and Willard Hart seconded the motion to approve these minutes as presented.  Motion carried unanimously, minutes stand as presented.

 

Appeal No. 305

 

Dave Cummans appeared before the Board of Adjustments and Variances seeking a variance to the Rainbow City Zoning Ordinance #360, Section 107, paragraph (b) “Each storage space shall be served by a paved driveway of 20 feet minimum width for each direction of travel”.  Mr. Cummans is seeking a second variance on Phase Three of Southtowne Mini Storage Warehouse on the paving of the driveway.  He stated he was given a variance four or five years ago and is requesting the same variance again since the first two phases of the storage warehouses are not paved.  After discussion, J. R. Martin moved to approve Mr. Cummans request to allow him to build the third phase of the storage warehouses without paving the driveway.  Motion died for lack of second.  Variance is denied.   

 

 

Appeal No. 306

 

Mr. & Mrs. Robert Carter appeared before the Board of Adjustments and Variances seeking to place a 16’ x 80’ mobile home on their property at 5278 Gilmer Lane.  Their home burned in March and they lost everything.  They can not afford to re-build their home but have found a new manufactured mobile home to place on their property.  The Carters have a petition signed by the neighbors stated they are not opposed to the mobile home being placed at this address.  Mr. Carter stated it will be underpinned and they will have a front and back porch once the home is in place.  They have pictures of a home like the one they intend to purchase with the porch in place.  There were two neighbors, Mrs. Ann Schomp and Fred Pinkston, here in favor of their request.  There was no one present

in opposition to this request.  After discussion, James New moved and Willard Hart seconded the motion to approve the Carters request to place the 16’ x 80’ mobile home at 5278 Gilmer Lane.  Motion carried unanimously.
