The City Council of the City of Rainbow City, Alabama, met in regular session at City Hall at 6:30 p.m., and upon roll call by Barbara T. Wester, City Clerk/Treasurer, the following members answered present:   Mayor: Terry John Calhoun; Council members: Anita Bedwell, Bobby McCartney, Lloyd Matthews, Larry Keenum and Kris Cornutt. The same constituting a quorum of the City Council, the following business was transacted. The meeting was called to order by Mayor Terry John Calhoun. Invocation was given by Anita Bedwell.   Mayor Calhoun led the Pledge of Allegiance to the flag.

 

Mayor Calhoun presented the minutes of August 22, 2011 for review and asked if there were any corrections, additions, or deletions. There being none, Larry Keenum made a motion to approve the minutes as presented. Lloyd Matthews seconded the motion. Mayor Calhoun stated all in favor say aye. All ayes. Mayor Calhoun declared the motion carried.

 

Mayor Calhoun asked for a motion to take the proposed yard sale ordinance off the table. Lloyd Matthews made a motion to this effect. Larry Keenum seconded the motion. Mayor Calhoun stated the council had a work session and decided to handle this through the nuisance abatement ordinance.

 

Mayor Calhoun turned over the hiring of a dispatcher to Larry Keenum, Police Department Chairman. He stated interviews were held today.   He then made a motion to hire Joy Dye at $10.00 per hour, and when she is certified, her pay will increase to $11.00 per hour.   Lloyd Matthews seconded the motion. Mayor Calhoun stated all in favor say aye. All ayes. Mayor Calhoun declared the motion carried.

 

Mayor Calhoun presented Ordinance No. 476, amending Ordinance No. 341, Section 8, pertaining to projects done by a contractor for the Utility Board. A signed contract shall be presented to the Utility Board prior to any construction, and the contractor shall furnish the Utility Board a two (2) year performance and payment bond.  He stated this is a public hearing, and asked if anyone has comments for or against this ordinance. There were no comments.   Kris Cornutt made a motion to introduce the ordinance.   Kris then made a motion to suspend the rules for immediate consideration.  Larry Keenum seconded the motion. Mayor Calhoun asked for a roll call vote as follows:

Mayor Calhoun presented Ordinance No. 477, for a Commercial Development Policy for the City. He stated this is a public hearing and asked if there is anyone who wants to speak for or against the ordinance. There were no comments. Lloyd Matthews made a motion to introduce the ordinance. Lloyd then made a motion to suspend the rules for immediate consideration. Mayor Calhoun asked for a roll call vote as follows:

Lloyd made a motion to adopt ordinance No. 477.   Kris Cornutt seconded the motion. Mayor Calhoun asked for a roll call vote as follows:

Mayor Calhoun asked that the records show that the Court Report was presented.

 

Mayor Calhoun stated that the Etowah County Rescue Squad sent in a request for a donation. Lloyd Matthews made a motion to give them $250.00. Anita Bedwell seconded the motion. Mayor Calhoun stated all in favor, say aye. All ayes. Mayor Calhoun declared the motion carried.   Mayor Calhoun stated that Community Action of Etowah County also sent in a request for a donation. Anita Bedwell made a motion to give them $250.00. Lloyd Matthews seconded the motion. Mayor Calhoun stated all in favor say aye. All ayes. Mayor Calhoun declared the motion carried.

 

Mayor Calhoun discussed two (2) lots at the following addresses that need mowed and cleaned up. They are as follows: 426 Riverton Drive and 205 Roseland Drive.

He asked the building official for comments. Wiley McLain stated that the front yard at 426 Riverton Drive has been mowed, and that he spoke with the mortgage company who has possession at this time, and they said they would come back and mow the back yard before the next council meeting. Lloyd made a motion to table this until the next council meeting. Kris Cornutt seconded the motion. Mayor Calhoun stated all in favor say aye. All ayes. Mayor Calhoun declared the motion carried. Wiley said the lot at 205 Roseland Drive has not been mowed or cleaned up, and he spoke with the owner and she is suppose to have it all cleaned up by Saturday, August 27, or the City will have it cleaned up. Lloyd made a motion to this effect. Kris Cornutt seconded the motion. Mayor Calhoun stated all in favor say aye. All ayes. Mayor Calhoun declared the motion carried.

 

Mayor Calhoun announced that the City received the final payment from FEMA on the debris removal. The amount was $4,778.96. The total the City received from them is $29,140.29. He also said the Trailer Park Drainage CDBG Project is going fine, and Diane Glen will be here next week to check the progress.   Mayor Calhoun then read a letter from the State Employees’ Insurance Board concerning wellness screenings. They will offer a premium discount of $10.00 per active employee per month, for an 80% participation of city employees in the wellness screenings. Discussion followed.  Mayor Calhoun said to contact Barbara for any questions, and to schedule an appointment. The Wellness Screening will be held around the end of September. Larry Keenum made a motion that if an employee did not participate, that employee would have to pay the amount of increase on their insurance. Lloyd Matthews seconded the motion. Mayor Calhoun stated all in favor say aye. All ayes. Mayor Calhoun declared the motion carried.

 

 

Mayor Calhoun said Waste Management was adding a Fuel/Environmental charge to the present service charges, effective with the next invoice.   The new rate will probably be a flat rate of $7.00 for small loads and $l4.00 for large loads, or 10% of all invoice charges.  

 

Mayor Calhoun said he received a proposal from Watts Seal Coating & Striping to re-stripe all parks around the front of City Hall, the side and back, and all the handicap parking and arrows for a total of $726.00. Lloyd Matthews made a motion to accept the proposal. Larry Keenum seconded the motion. Mayor Calhoun stated all in favor say aye.   All ayes.   Mayor Calhoun declared the motion carried.

 

Mayor Calhoun also stated he received a letter from EMA that they received the application for the City’s Safe Room Project No. 71-121 on August 12, 2011.   He also reported that the Gadsden Etowah Metropolitan Planning Organization is developing an area wide bicycle and pedestrian plan.   The estimated cost is $100,000.00, with a Federal 80/20 split. Rainbow City’s proposed proportion of the local share is $l, 812.53. Discussion followed. Larry Keenum made a motion to table until the next Council meeting for further study. Anita Bedwell seconded the motion.   Mayor Calhoun stated all in favor say aye. All ayes. Mayor Calhoun declared the motion carried.

 

Larry Keenum made a motion for Officer Deborah Overby to attend a training class in Boaz at the Boaz Police Department on September 21, 2011. The name of the class is Sovereign Citizens & Hate Groups.   There will be no charge for the class. Lloyd Matthews seconded the motion. Mayor Calhoun stated all in favor say aye. All ayes. Mayor Calhoun declared the motion carried.   Larry also made a motion to post the police badge of Ernie Norton and close the bid September 12, 2011. Lloyd Matthews seconded the motion. Mayor Calhoun stated all in favor say aye. All ayes. Mayor Calhoun declared the motion carried.

 

There being no further business to come before the Council at this time, Bobby McCartney made a motion to adjourn.
