The City Council of the City of Rainbow City, Alabama, met in regular session at City Hall at 6:30 p.m., and upon roll call by the City Clerk, Barbara T. Wester, the following members answered present: Mayor, Terry John Calhoun, Council members: Bobby McCartney, Lloyd Matthews, Larry Keenum and Kris Cornutt. Anita Bedwell was absent. The same constituting a quorum of the City Council, the following business was transacted. The meeting was called to order by Mayor Calhoun. Invocation was given by Larry Keenum. Mayor Calhoun led the Pledge of Allegiance to the flag.

 

Mayor Calhoun presented the minutes of August 9, 2010 for review and asked if there were any corrections, additions or deletions. There being none, Lloyd Matthews made a motion to approve the minutes as presented. Larry Keenum seconded the motion. Mayor Calhoun stated all in favor say aye. All ayes. Mayor Calhoun declared the motion carried.

 

Mayor Calhoun stated this is a public hearing for Ordinance No. 474, changing the Rainbow City zoning ordinance, Section 40, paragraph (2) Conditional uses, paragraph d, Commercial uses. Also, under Appendix “A” use classification “AG” change the “N” (not permitted) to “C” (Conditional Use Permit). These changes were recommended by the Planning Commission. Lloyd Matthews made a motion to introduce the ordinance. Lloyd moved and Bobby McCartney seconded the motion to suspend the rules for immediate consideration. Mayor Calhoun asked for a roll call vote as follows:

Mayor Calhoun declared the motion carried. Larry Keenum moved and Lloyd Matthews seconded the motion to adopt Ordinance No. 474. Mayor Calhoun asked for a roll call vote as follows:

Mayor Calhoun stated he received a letter from the City Engineers recommending the Council to approve for Alagasco to install a 2” gas main on Guy Lee Lake Road and Baypoint Drive. It has been confirmed that all roadway crossings will be installed by directional bore, therefore; no excavations will be made within paved areas. Discussion followed. Bobby McCartney made a motion to approve this request. Larry Keenum seconded the motion. Mayor Calhoun stated all in favor say aye. All ayes. Mayor Calhoun declared the motion carried.

 

Mayor Calhoun stated the Street & Sanitation Committee has met concerning changes to the trash rate charge, and recognized Lloyd Matthews, Chairman. Lloyd stated the trash pickup for destroyed buildings, contract/construction trash, and trees cut down by a contractor will be a minimum fee of $45.00 plus $45.00 per ton thereafter. The fees will be paid to the Revenue Department before the work is done. Lloyd stated he would like to put this in the form of a motion. Kris Cornutt seconded the motion. Mayor Calhoun stated all in favor say aye. All ayes. Mayor Calhoun declared the motion carried.

 

Mayor Calhoun stated the Court Office has a Lexmark Optra S1625 Printer #4059-165 (broken) that needs to be surplused.   Bobby McCartney made a motion to surplus this printer and open bids at 6:00 p.m., September 13, 2010. Larry Keenum seconded the motion. Mayor Calhoun stated all in favor say ayes. All ayes. Mayor Calhoun declared the motion carried.

 

Mayor Calhoun stated Linda Cleveland has been working twenty hours a week in the Revenue Department, and Cheryl Ayres, Revenue Officer has requested she work twenty-four hour a week, because of the revenue she is helping to bring in. Lloyd Matthews made a motion to increase the hours. Kris Cornutt seconded the motion. Mayor Calhoun stated all in favor say aye. All ayes. Mayor Calhoun declared the motion carried.

 

Kris Cornutt stated he met with the Fire Department Committee and with Chief Potter, discussing overtime in the department.   Kris then made a motion that beginning on October 1; the fireman will work on a 28 day cycle, consisting of 216 hours. They will be paid overtime once monthly after the 216 hours has been reached, and have to be on shift working in the 28-day cycle. There will be three (3) exceptions to this: (1) annual vacation, (2) funeral leave, and (3) education leave. One-half vacation is scheduled at the end of the year. After February l, 2011, vacation will not count in the 216 hours worked in the 28 day cycle. Kris stated this is the recommendation of the Fire Chief. Larry Keenum seconded the motion. Mayor Calhoun stated all in favor say aye. All ayes. Mayor Calhoun declared the motion carried.

 

Larry Keenum reported the red D.A.R.E truck sold on GovDeals for $6,380.00, on August 16, 2010. Chief Ragan wants to use the funds to purchase a new video system for the patrol cars. Discussion followed. Larry stated he would like to put this in the form of a motion. Bobby McCartney seconded the motion. Mayor Calhoun stated all in favor say aye. All ayes. Mayor Calhoun declared the motion carried.

 

Tina Brooks, Librarian, appeared before the council discussing the summer reading program. The library had 586 participants, ages 4-12 who read an estimated 9,500 books.

The teen program had 39 participants who read an estimated 120 books, and the adult program had 155 participants who read 663 books. She also announced that September is National Library sign up month. You will be able to replace your lost or damaged library card for only $1.00.

 

Bobby McCartney stated Ryan Ramsey appeared at precouncil discussing his Eagle Scout Project. Bobby said he wants to repair the sign at Rainbow Landing, repaint the bathrooms and stain the wood and pavilions back to a dark color, remove the stumps and shrubs and plant some trees. He plans to post a sign that tells what the trees are and what they can be used for. Bobby stated he wants to put this in the form of a motion and give him $400.00 to cover the cost. Kris Cornutt seconded the motion. Mayor Calhoun stated all in favor say aye. All ayes. Mayor Calhoun declared the motion carried.

 

Mayor Calhoun welcomed Mrs. Marguerite Early, Principal of Southside High and Allan Cosby, Superintendent.   Mr. Cosby asked that the Council continue sending two (2) officers to go with the Southside Band to the ballgames. Lloyd Matthews made a motion for the two (2) officers to continue with the band. Kris Cornutt seconded the motion. Mayor Calhoun stated all in favor say aye. All ayes. Mayor Calhoun declared the motion carried.

 

There being no further business to come before the Council at this time, Kris Cornutt made a motion to adjourn.
