The City Council of the City of Rainbow City, Alabama, met in regular session at City Hall at 6:30 p.m., and upon roll call by the City Clerk, Barbara T. Wester, the following members answered present:

The same constituting a quorum of the City Council, the following business was transacted.

 

  1. The meeting was called to order by Mayor Calhoun.

 

  1. Invocation was given by Mayor Charles Gilchrist.

 

  1. Mayor Calhoun led the pledge of allegiance to the flag.

 

  1. Mayor Calhoun presented the minutes of December 10, 2007 for review and asked if there were any corrections, additions or deletions. There being none, Bryan Stone moved and Bobby McCartney seconded the motion to approve the minutes as presented. Mayor Calhoun declared the motion carried.

 

  1. Mayor Calhoun stated that a public hearing was held at the last council meeting for the adoption of the Comprehensive Plan for the City, and he asked again if anyone would like to speak for or against the plan. No comments were made concerning the adoption. Bryan Stone moved and Cora Kelly seconded the motion to adopt the plan (Resolution No. 08-02)

 

as presented and recommended by the Planning Commission. Mayor Calhoun declared the motion carried.

 

  1. Mayor Calhoun stated a public hearing is being held concerning the following changes to Zoning Ordinance No. 360, and asked if anyone would like to speak for or against the changes. (l) Section 146—paragraph (a) and (b)—setbacks for accessory buildings shall be 7.5 feet from any side or rear property line. (2) Section 314—paragraph (a) (7) all new subdivisions shall be tied to The State Plane Coordinate, both Vertical and Horizontal Datum. (3) Section 83—HC-RL—this section will be for restaurant liquor sales, which when zoned with this RL suffix, will state that to be zoned HC-RL, 60% of total sales shall come from food sales. No comments were made concerning the changes.

Bryan Stone made a motion to introduce the changes to the ordinance. Kris Cornutt moved and Lloyd Matthews seconded the motion to suspend the rules for immediate consideration. Mayor Calhoun asked for a roll call vote as follows:

  1. Cora Kelly moved and Lloyd Matthews seconded the motion to adopt these changes.   Mayor Calhoun asked for a roll call vote:

  1. Mayor Calhoun asked that the minutes show that Charlie Bell retired effective September 30, 2007.

 

  1. Mayor Calhoun presented an ad request from the Southside High School Soccer Association.   Lloyd Matthews moved and Kris Cornutt seconded the motion to purchase a 4 X 6 banner for $225.00. Mayor Calhoun declared the motion carried.

 

  1. Mayor Calhoun presented an ad request from Southside High School Baseball Association for the renewal of a 4 X 8 ad for $l00.00. Kris Cornutt moved and Lloyd Matthews seconded the motion to renew the ad.   Mayor Calhoun declared the motion carried.

 

  1. Mayor Calhoun presented a street light request for the corner of Westminster Drive and English Pass, pole no. 2-142769.   Bryan Stone moved and Kris Cornutt seconded the motion to grant the request.   Mayor Calhoun declared the motion carried.

 

  1. Mayor Calhoun presented a request from the Greater Etowah 310 Board for a donation in the amount of $1200.00.   Lloyd Matthews moved and Bobby McCartney seconded the motion to approve this request.   Mayor Calhoun declared the motion carried.

 

  1. Mayor Calhoun presented a request from the Chamber of Commerce for the City to purchase a table at the Annual Chamber Dinner for $280.00.   Cora Kelly moved and Bobby McCartney seconded the motion to make this purchase.   Mayor Calhoun declared the motion carried.

 

  1. Mayor Calhoun presented a request from Chief Ragan to amend the police department budget because of a check the department received from the Etowah County D.A.R.E./S.R.O.   The $1,847.4l proceeds were from a golf tournament.   He requested the funds be used for drug education materials. A check was also received from Fred’s Department Store for $177.50 as part of a promotion to assist local law enforcement on 9/11, and he requested these funds be put back into the police budget for office supplies.   Cora Kelly moved and Bobby McCartney seconded the motion to amend the police department budget and to use the funds as the chief requested.   Mayor Calhoun declared the motion carried.

 

  1. Mayor Calhoun asked that the minutes show that the monthly departmental reports were presented.   He then asked if the council or department heads has any comments. Bobby McCartney stated that the Community Center served 24,576 during the year and there were 456 activities held.

 

  1. Mayor Calhoun presented a request from the City Clerk to surplus a broken HP Office jet 6210 Fax, Copier and Scanner.   Lloyd Matthews moved and Kris Cornutt seconded the motion to surplus this item.   Mayor Calhoun declared the motion carried.

 

  1. Mayor Calhoun asked for a motion to hire Emily Brown as dispatcher at $9.75 per hour effective December 28, 2007.   Cora Kelly moved and Bryan Stone seconded the motion to hire Emily.   Mayor Calhoun declared the motion carried.

 

  1. Mayor Calhoun presented a request from Chief Ragan to order a new police vehicle with funds from the ADECA Grant. Kris Cornutt moved and Bryan Stone seconded the motion to approve this request.   Mayor Calhoun declared the motion carried.

 

  1. Mayor Calhoun presented Resolution No. 08-01 giving him the authority to sign an Agreement with the State of Alabama, acting by and through the Alabama Department of Transportation for a Construction Agreement for Project No. STPOA-8105, to widen Steele Station Road from Hwy 77 to Sutton Bridge Road in Rainbow City. Kris Cornutt moved and Bryan Stone seconded the motion to adopt this resolution.   Mayor Calhoun declared the motion carried.

 

  1. Mayor Calhoun presented a request from the Messenger for the Progress “08 Gadsden-Etowah County in the amount of $695.00 for a ½ page. Bryan Stone made a motion to purchase the ad. The motion died for lack of a second.

 

  1. Lloyd Matthews stated he has received several calls concerning trash pickup. Lloyd also stated he would like to thank Charlie Bell for all his years of service. He asked the Council to consider giving employees who had been with the city a long time longevity pay, and to give the employee a certain amount of pay one time a year.   He said he felt this would help to keep good employees on the job. He stated he would bring this up again at the next council meeting in the form of a motion.

 

  1. Kris Cornutt stated that Monday, January 21st will be another holiday and garbage will be delayed a day.

 

  1. Bryan Stone stated the City passed a new pay scale in December, and some employees were off the 25 cents scale, and he would like to add the 22 employees on the pay scale to the next 25 cents level.   Bryan moved and Kris Cornutt seconded the motion to add these employees to the pay scale.   Mayor Calhoun declared the motion carried.

 

  1. Cora Kelly stated it gave her great pleasure, per the recommendation of Chief Ragan to promote Tommy Watts to Captain at his rate of pay.   Cora moved and Lloyd Matthews seconded the motion to make the promotion.   Mayor Calhoun declared the motion carried.

 

There being no further business to come before the Council at this time, Bryan Stone made a motion to adjourn.
