The City Council of the City of Rainbow City, Alabama, met in regular session at City Hall at 6:00 p.m., and upon roll call by the City Clerk, Barbara T. Wester, the following members answered present: Mayor: Terry John Calhoun, Council members: Anita Bedwell, Bobby McCartney, Tim Ramsey, Larry Keenum and Rick Hill. The same constituting a quorum of the City Council, the following business was transacted. The Meeting was called to order by Mayor Calhoun. Invocation was given by Bobby McCartney. Mayor Calhoun led the Pledge of Allegiance to the flag.

 

  1. Mayor Calhoun presented the minutes of December 10, 2012 for review, and asked if there were any corrections, additions, or deletions. There being none, Anita Bedwell made a motion to approve the minutes as presented. Larry Keenum seconded the motion. Mayor Calhoun declared the motion carried.

 

  1. Mayor Calhoun stated this is a public hearing concerning Ordinance No. 492, revoking Ordinance No. 423. These changes will allow the City to charge for any and all cleanup that has to be performed by the City and/or Contractors. Bobby McCartney made a motion to introduce the ordinance. Anita Bedwell made a motion to suspend the rules for immediate consideration. Rick Hill seconded the motion. Mayor Calhoun asked for a roll call vote as follows: Anita Bedwell, yes; Bobby McCartney, yes; Tim Ramsey, yes; Larry Keenum, yes; Rick Hill, yes; and Mayor Calhoun, yes. Mayor Calhoun declared the motion carried.

 

Anita Bedwell made a motion to adopt Ordinance No. 492. Larry Keenum seconded the motion. Mayor Calhoun asked for a roll call vote as follows: Anita Bedwell, yes; Bobby McCartney, yes; Tim Ramsey, yes; Larry Keenum, yes; and Rick Hill, yes. Mayor Calhoun declared the motion carried.

 

  1. Mayor Calhoun said the Board of Adjustment made a request to change the fee for a request from them, from $25.00 to $100.00. Rick Hill made a motion to change the fee to $l00.00. Anita Bedwell seconded the motion. Mayor Calhoun stated all in favor say aye. All ayes. Mayor Calhoun declared the motion carried.
  2. Mayor Calhoun presented the attached list of items to surplus for the Police Department. The camper trailer will be marked off the list. All items have to be bid on at one time, and there will be no items bid on separately. The items will have to be hauled off as soon as possible. Bobby McCartney made a motion to declare the list as surplus, and open bids at the next pre-council meeting.   Tim Ramsey seconded the motion. Mayor Calhoun stated all in favor say aye. All ayes. Mayor Calhoun declared the motion carried.

 

  1. Mayor Calhoun presented an application from Local Joes Trading Post, 4967 Rainbow Drive, to sell Retail Table Wine (Off Premises Only). Tim Ramsey made a motion to approve the request. Rick Hill seconded the motion. Mayor Calhoun stated all in favor say aye. All ayes. Mayor Calhoun declared the motion carried.

 

  1. Mayor Calhoun presented a Memorandum of Understanding between Rainbow City and the City of Gadsden. It is for the usage of their facility for the fireman’s training. The cost is $15,000.00 yearly, and this will help with the upkeep and the purchase of equipment.  Discussion followed. Bobby McCartney made a motion to table until the next Council meeting. Larry Keenum seconded the motion. Mayor Calhoun asked for a roll call vote as follows: Anita Bedwell, yes; Bobby McCartney, yes; Tim Ramsey, yes; Larry Keenum, yes; Rick Hill, no. Mayor Calhoun declared the motion carried.

 

  1. Heath Williamson, City/Utility Engineer, discussed the estimated cost for each entity for Storm Water Monitoring. Rainbow City’s estimated cost for monitoring is $3,737.80, and $709.50, for the storm water management report preparation. Anita Bedwell made a motion to accept these estimates as the city’s cost. Larry Keenum seconded the motion. Mayor Calhoun stated all in favor say aye. All ayes. Mayor Calhoun declared the motion carried.

 

  1. Mayor Calhoun presented a cost of $350.00 for a table at the Annual Chamber Dinner, January 25, 2013. Anita Bedwell made a motion to purchase the table. Tim Ramsey seconded the motion. Mayor Calhoun stated all in favor say aye. All ayes. Mayor Calhoun declared the motion carried.

 

  1. Mayor Calhoun presented a request from the American Red Cross for an appropriation. Died for lack of a motion.

 

  1. Mayor Calhoun presented the following tuition/travel:

Heath Williamson to attend Auburn University of Engineering. One night stay, and tuition of $200.00. The dates are February 12-13, 2013.

               

Wiley McLain to attend the 50th Annual Educational Conference of the Alabama Association of Plumbing, Gas and Mechanical Inspectors in Auburn, April 2-5, 2013.   Registration is 130.0 and room cost is $261.00.

 

Det. Sgt. Gerald Lyons to attend the Crime Scene Investigation Certificate Program in Jacksonville. There will be three (3) classes: January 16, May 13, and May 15-16. Cost is $373.00 for registration.

 

Officer Philip Braswell and Justin McGlaughn to attend the ShivWorks Armed Movement in Structures course at Gadsden Firing Range, January 26-27. Cost $450.00.

 

Rick Hill made a motion to approve the tuition/travel. Anita Bedwell seconded the motion. Mayor Calhoun stated all in favor say aye. All ayes. Mayor Calhoun declared the motion carried.

 

  1. Mayor Calhoun stated a 2010 Impala, serial number 9760, was wrecked December 25, 2012. The adjuster stated the vehicle will be totaled. Chief Carroll wants to replace this vehicle. Rick Hill made a motion to replace the car off the State Bid list. Larry Keenum seconded the motion. Mayor Calhoun stated all in favor say aye. All ayes. Mayor Calhoun declared the motion carried.

 

  1. Mayor Calhoun presented a request from the Progress “13, which the Messenger will publish on February 22, 2013. Died for lack of a motion.

 

  1. Mayor Calhoun presented a request from the Southside lady panther’s softball, for a $100.00 sign renewal. Tim Ramsey made a motion to renew the sign. Rick Hill seconded the motion. Mayor Calhoun stated all in favor say aye. All ayes. Mayor Calhoun declared the motion carried.

 

  1. Mayor Calhoun stated the 2013 Sales Tax Holiday, for Severe Weather Preparedness items, will be February 22-24, 2013. Tim Ramsey made a motion that the city will participate. Anita Bedwell seconded the motion. Mayor Calhoun stated all in favor say aye. All ayes. Mayor Calhoun declared the motion carried.

 

  1. Mayor Calhoun presented the following monthly departmental reports: Building, Library, Community Center, Fire and Police Department. He asked if anyone has comments. There being none, he asked that the minutes show that the reports were presented.

 

  1. Bobby McCartney thanked everyone for their prayers for his son. He said all life issues are over and he will be o.k.

 

  1. Mayor Calhoun said a house fire was on West Hartwood, and said the fire department did a good job handling this. He then thanked all the employees for doing a good job. He said the Street and Sanitation has had a hard two (2) weeks.

 

  1. There being no further business to come before the Council at this time, Tim Ramsey made a motion to adjourn.
