The City Council of the City of Rainbow City, Alabama, met in regular session at City Hall at 6:30 p.m., and upon roll call by the City Clerk, Barbara T. Wester, the following members answered present:

The same constituting a quorum of the City Council, the following business was transacted.

 

  1. The meeting was called to order by Mayor Calhoun.

 

  1.   Invocation was given by Cora Kelly.

 

  1. Mayor Calhoun led the Pledge of Allegiance to the flag.

 

  1. Mayor Calhoun presented the minutes of June 23, 2008 for review and asked if there were any corrections, additions, or deletions. There being none, Cora Kelly moved and Kris Cornutt seconded the motion to approve the minutes as presented.   Mayor Calhoun declared the motion carried.

 

  1. Mayor Calhoun presented Ordinance No. 459, and stated this is a public hearing concerning the rezoning of approximately 19 acres of land at the end of Crescent Court. It runs along Shields Avenue and Mr. Bryan Ledbetter wants to rezone from Highway Commercial to R-2, Patio & Garden Home District. The entrance to the subdivision will be off Crescent Court.  Mayor Calhoun stated that the Planning Commission heard this request and recommended the rezoning. He asked if anyone has comments for or against the rezoning.   No one spoke for the ordinance. Aaron Swindall stated the property joins his property, and he would like to leave it commercial. Discussion followed.   Mayor Calhoun stated the next public hearing would be at the next council meeting.

 

  1. Mayor Calhoun presented Ordinance No. 460 concerning compensation for the Absentee Election Manager. It is fixed at $50.00 per day for each day absentee election services are performed, and are to be paid from the city treasury.   Cora Kelly                     made a motion to introduce the ordinance.   Kris Cornutt moved and Lloyd Matthews seconded the motion to suspend the rules for immediate consideration. Mayor Calhoun asked for a roll call vote as follows:

  1. Cora Kelly moved and Kris Cornutt seconded the motion to adopt Ordinance No. 460. Mayor Calhoun asked for a roll call vote as follows:

Mayor Calhoun declared the motion carried.

 

  1. Mayor Calhoun presented Resolution No. 08-08 to amend the employee’s hand book as follows: Each employee will be credited with one week (5 days) annual leave upon satisfactory completion of twelve (12) months of employment.   Thereafter, each employee will be given annual leave on their anniversary date as follows:

 

Completion of one year—one week

Completion of two years—two weeks

Completion of 5 years—three weeks

Completion of 15 years—four weeks

 

Once employees complete 12 months of employment, annual leave will be calculated on a calendar year. Accrual of additional annual leave when earned will be given on anniversary date. Employees must obtain approval from the department head before annual leave.   Sections b), c), and d) of Section 4 remain unchanged.

Lloyd Matthews moved and Cora Kelly seconded the motion to amend the employee handbook. Mayor Calhoun declared the motion carried.

 

  1. Mayor Calhoun presented Resolution #08-09.   The City is submitting a grant through the Alabama Power Company Industrial Site Development Program, and the purpose of the grant is to provide power for the Deerfoot Park No. 2 Industrial Park. Bobby McCartney moved and Cora Kelly seconded the motion to adopt the resolution.   Mayor Calhoun declared the motion carried.

 

  1. Mayor Calhoun presented an application for retail beer and wine, off premises only. Rainbow Food Mart #127 is owned by Tom Van Dang. Bobby McCartney                          moved and Cora Kelly seconded the motion to grant the request.   Mayor Calhoun declared the motion carried.

 

  1. Mayor Calhoun presented a recommendation from Chief Potter to give a one-step pay raise to Todd Cook, Dustin Vice and Vinson Dupree for completion of their Firefighter I and Firefighter II Training.   Cora Kelly moved and Lloyd Matthews                                       seconded the motion to give the raise.   Mayor Calhoun declared the motion carried.

 

  1. Mayor Calhoun presented a recommendation from Chief Potter to declared one Pierce Rescue pumper, serial #1572 as surplus and sell on govdeals.com.   He also recommends transferring one 2000 Ford Explorer, serial #1134 to the Street Department and one 1996 Ford Bronco, serial #9522 to the Park & Recreation Department. Cora Kelly moved and Lloyd Matthews seconded the motion to approve the chief’s recommendations.   Mayor Calhoun declared the motion carried.

 

  1. Mayor Calhoun announced that Movies under the Stars has been cancelled due to

scheduling a date before high school football begins.

 

  1. Mayor Calhoun stated the City is receiving a grant from Sam’s Club in the amount of $1,000.00 earmarked for playground equipment at the Vivian Lee Maddox Sports Complex.

 

  1. Mayor Calhoun stated that the County is going to install a bridge at Martin Road and the City is going to purchase a railcar for $13,000.00. Bobby McCartney moved and

Kris Cornutt seconded the motion to purchase the railcar.   Mayor Calhoun declared the motion carried.

 

  1. Mayor Calhoun stated he had a request from Deborah Franklin to take family leave to take care of Charlie Bell, a former police officer. Cora Kelly moved and Lloyd Matthews seconded the motion to grant the leave.   Mayor Calhoun declared the motion carried.

 

  1. Mayor Calhoun announced that Congressman Aderholt’s office called and stated the City is receiving a $l,000,000.00 grant from the EPA (Environmental Protection Agency).   Jana Monday of CDG Engineers appeared before the council several months ago and stated if the city got the grant, they wanted to do the work. (Her office applied for the grant). It is a 55/45 match.

 

  1. Mayor Calhoun stated specs were prepared to redo all the piers and walking bridge at Rainbow Landing. Bobby McCartney moved and Lloyd Matthews seconded the motion to send out bids and open them on July 28, 2008 at 6:00 p.m. Mayor Calhoun declared the motion carried.

 

  1. Mayor Calhoun asked the Department Heads to have their budget in by the end of the month so the committees can review them.

 

  1. Mayor Calhoun presented a recommendation from Chief Ragan to give a one-step pay increase to Emily Brown who completed her probationary period on June 28, 2008.

Cora Kelly moved and Lloyd Matthews seconded the motion to give the raise.

Mayor Calhoun declared the motion carried.

 

  1. Mayor Calhoun asked that the records show that the monthly departmental reports were presented.

 

  1. Mayor Calhoun presented a recommendation from Chief Potter that the proceeds from the sale of Rescue 1 be used to purchase two (2) high flow “monitor” systems, one for each of the two (2) pumpers at a cost of $6200.00 each. Cora Kelly moved and Bobby McCartney seconded the motion to grant the request.   Mayor Calhoun declared the motion carried.

 

  1. Mayor Calhoun presented a request for a cash donation for the Coosa Baseball Association 12 year old All Star Team.   Lloyd Matthews moved and Kris Cornutt

seconded the motion to give $250.00 to the team. Mayor Calhoun declared the motion carried.

 

  1. Lloyd Matthews stated he had complaints from people putting trash in the road.

He stated this is a safety hazard, and asked that anyone doing this would stop.

 

  1. Kris Cornutt stated that the Summer Reading Program is winding down. The year end party will be on the 30th of this month. He stated all the programs have had an excellent turnout.

 

  1. Bobby McCartney stated he wanted to recognize Ken Roark, past president of the Lions Club for his commitment in getting a new flag pole at the new complex.   He also announced that the paving at the walking trail will be started in the next few weeks. Bobby said he had a citizen who wanted to thank the people on the garbage truck for leaving their garbage can standing up. Lloyd Matthews stated that the President of the Little League praised Eddie Cline and the Recreation Department for the good job they did at a recent tournament.

 

  1. Mayor Calhoun stated that he wanted to pass on to the medics that a nurse stated that Steve Tate saved Don Owens life recently, and she also stated that we had the best medics in the county.

 

There being no further business to come before the council at this time, Cora Kelly made a motion to adjourn.
