The City Council of the City of Rainbow City met in regular session at City Hall at 6:30 p.m., and upon roll call by the City Clerk, Barbara T. Wester, the following members answered present: Mayor Terry John Calhoun, Council members: Anita Bedwell, Bobby McCartney, Lloyd Matthews, Larry Keenum and Kris Cornutt. The same constituting a quorum of the City Council, the following business was transacted. The meeting was called to order by Mayor Calhoun. Invocation was given by Larry Keenum.   Mayor                                  Calhoun led the Pledge of Allegiance to the flag.

 

  1. Mayor Calhoun presented the minutes of October 27, 2008 and Organizational Meeting of November 3, 2008 for review and asked if there were any corrections, additions, or deletions. There being none, Anita Bedwell made a motion to approve the minutes. Lloyd Matthews seconded the motion. Mayor Calhoun stated all in favor say aye. All ayes. Mayor Calhoun declared the motion carried.

 

  1. Mayor Calhoun stated the clerk opened bids at 6:00 p.m. for the bleachers at the Vivian Lee Maddox Sports Complex.  Two (2) bids were received. American Park and Recreation Company has a bid of $27,776.00. Highland Products Group, LLC has a bid of $27,124.64.   Bobby McCartney made a motion to accept the low bid from Highland Products, pending specs is met.   Lloyd Matthews seconded the motion.   Mayor Calhoun stated all in favor say aye. All ayes. Mayor Calhoun declared the motion carried.

 

  1. Mayor Calhoun recommended the appointment of Jay E. Stover as City Judge. Bobby McCartney made a motion to appoint Judge Stover. Kris Cornutt seconded the motion. Mayor Calhoun stated all in favor say aye. All ayes. Mayor Calhoun declared the motion carried.

 

  1. Mayor Calhoun recommended the appointment of Walt Buttram as Public Defender. Kris Cornutt made a motion to appoint Walt as Public Defender. Motion died for lack of a second.   Bobby McCartney made a motion to table the appointment of the Public Defender. Lloyd Matthews seconded the motion. Mayor Calhoun asked for a roll call vote.

  1. Mayor Calhoun recommended the appointment of Jones, Blair, Waldrup & Tucker, Inc. as City Engineers.   Bobby McCartney made a motion to appoint Jones, Blair, Waldrup & Tucker and Eddie Perman as City Engineers. Lloyd Matthews seconded the motion. Mayor Calhoun stated all in favor say aye.   All ayes. Mayor Calhoun declared the motion carried.

 

  1. Mayor Calhoun appointed Michele D. Wiles as City Auditor.

 

  1. Mayor Calhoun recommended the use of all present depositories for municipal funds to remain the same.   Larry Keenum made a motion to keep all depositories the same. Bobby McCartney seconded the motion. Mayor Calhoun stated all in favor say aye. All ayes.   Mayor Calhoun declared the motion carried.

 

  1. Mayor Calhoun presented the Solid Waste Disposal Contract. It was negotiated in 2002 at $18.00 per ton and renewed in 2005 at $18.00 per ton.   It will increase to $19.83 per ton.   The contract renews every three (3) years with Waste Management. (Three Corners Landfill). Anita Bedwell made a motion to renew the contract. Lloyd Matthews seconded the motion. Mayor Calhoun stated all in favor say aye. All ayes. Mayor Calhoun declared the motion carried.

 

  1. Mayor Calhoun presented a request from United Way of Etowah County, ComeUnity Thanksgiving Celebration County-wide event at Convention hall to feed the people of Etowah County on Thanksgiving Day.   Lloyd Matthews made a motion to give $500.00 to the county wide event.   Larry Keenum seconded the motion. Mayor Calhoun stated all in favor say aye. All ayes. Mayor Calhoun declared the motion carried.

 

  1. Mayor Calhoun asked the Council to accept the following resignations: Blake Winningham in the Recreation Department effective November 3, 2008 and Tommy Hudson in the Sanitation Department effective November 7, 2008.   He asked both positions be posted and hire at the starting rate of pay.   Kris Cornutt made a motion to

post the positions and close Monday, November 24 at 2:00 p.m. Lloyd Matthews seconded the motion. Mayor Calhoun stated all in favor say aye. All ayes. Mayor Calhoun declared the motion carried.

 

  1. Mayor Calhoun asked that the records show that all monthly departmental reports were presented. They are Police & Animal Control, Fire, Community Center, Building, Library and Court.

 

  1. Lloyd Matthews stated the Council went to Southside High School for a Veteran’s Day Program and it was very good. He also stated he wanted the minutes to state that any employee in the City who needs to talk to him at any time, at his home or on the phone can without reprisal.  Lloyd also read out of the City’s Personnel Rules and Regulations Book, on page 28 concerning grounds for disciplinary action that no one is allowed to use profane or insolent language to any employee. He stated this would be grounds for dismissal.

 

  1. Larry Keenum stated the Police Department has two (2) vehicles with over l00,000 miles that has stopped operating, and the Chief would like to purchase two (2) Chevrolet

Impalas from Larry Puckett Chevrolet, Inc. for a price of $17,151.25 each. He stated he would like to purchase the vehicles for $17,000.00 each, if possible. Ronnie Watkins Ford has two (2) Crown Vics, but they are $2600.00 higher on each vehicle. All these vehicles are on the State Bid List. Larry made a motion to purchase the Impalas from Larry Puckett Chevrolet.   Lloyd Matthews seconded the motion. Mayor Calhoun stated all in favor say aye. All ayes. Mayor Calhoun declared the motion carried.

 

  1. Bobby McCartney stated the walking track at the Vivian Lee Maddox Sports Complex is looking very good, and the lines are down to separate the walking track from the bike track. He also stated he has $12,875.00 left from the Community Development Grant ($40,000.00) for the purchase of the bleachers and would like to give the Director, Eddie Cline the authority to purchase two (2) refrigerators, two (2) pop corn machines, and two (2) ice machines for the complex.   None of these items have to be bid out.

Bobby made a motion to give Eddie the authority to purchase these items. Anita Bedwell seconded the motion. Mayor Calhoun stated all in favor say aye. All ayes.   Mayor Calhoun declared the motion carried.

 

  1. Trent Thrasher appeared before the Council asking for permission to locate a billboard on his property across from Rainbow Memorial Gardens. Discussion followed.

Bobby McCartney made a motion to table the request until the next Council Meeting. Larry Keenum seconded the motion. Mayor Calhoun stated all in favor say aye.   All ayes. Mayor Calhoun declared the motion carried.

 

  1. Ken Roark appeared before the Council and stated that the Lions Club had received their nuts for the nut sales.

 

  1. Mayor Calhoun announced that a Work Session with the City Engineer would be November 19, 2008 at 8:30 a.m.

 

 

There being no further business to come before the Council at this time, Bobby McCartney made a motion to adjourn.
