The City Council of the City of Rainbow City, Alabama, met in regular session at City Hall at 6:00 p.m., and upon roll call by Barbara T. Wester, City Clerk/Treasurer, the following members answered present: Mayor: Terry John Calhoun, Council members: Anita Bedwell, Bobby McCartney, Tim Ramsey, Larry Keenum, and Rick Hill. The same constituting a quorum of the City Council, the following business was transacted. The meeting was called to order by Mayor Calhoun. Invocation was given by Brother Rodney Prickett, Riddles Bend Baptist Church. Mayor Calhoun led the Pledge of Allegiance to the flag.

 

  1. Mayor Calhoun presented the minutes of October 22, 2012, and November 5, 2012 for review, and asked if there were any corrections, additions, or deletions. There being none, Anita Bedwell made a motion to approve the minutes as presented. Larry Keenum seconded the motion. Mayor Calhoun stated all in favor say aye. All ayes. Mayor Calhoun declared the motion carried.

 

  1. Mayor Calhoun stated that Justin Hayes needs to be appointed as a Public Defender for the City.   The City needs two (2) defenders. Larry Keenum made a motion to appoint Justin as Co-Defender.   Rick Hill seconded the motion. Mayor Calhoun stated all in favor say aye. All ayes. Mayor Calhoun declared the motion carried.

 

  1. Mayor Calhoun stated the Librarian needs a Book Drop at the library. She obtained three (3) bids. They are as follows: American Book Returns has quotes of $4,824.00, and $6,008.00. The JMC Group has a quote of $5,964.13. Anita Bedwell made a motion to accept the low bid of $4,824.00. Rick Hill seconded the motion. Mayor Calhoun stated all in favor say aye. All ayes. Mayor Calhoun declared the motion carried.

 

  1. Mayor Calhoun reported that the City uses Waste Management for solid waste disposal. They are going out of business, and he has contacted Mayor Guyton, City of Gadsden, and they are willing to let us use their Transfer Station, beginning on December 3, at $50.00 per ton, until the City finds other means.   No electronics, tires, or liquids are allowed.   Anita Bedwell made a motion to this effect. Tim Ramsey seconded the motion. Mayor Calhoun stated all in favor say aye. All ayes. Mayor Calhoun declared the motion carried.

 

  1. Mayor Calhoun reported that Marrilyn Garrison’s last day of work at the library is November 17, 2012. Tina Brooks, Librarian would like to hire Robin Whyte to fill the permanent part-time vacancy at $7.25 per hour, starting December 3, 2012. Anita Bedwell made a motion to hire Robin. Larry Keenum seconded the motion. Mayor Calhoun stated all in favor say aye. All ayes. Mayor Calhoun declared the motion carried.

 

  1. Mayor Calhoun said the Etowah County Library Committee gave the library a $15,000.00 allocation, and an unexpected $5,000.00 allocation. Tina needs to amend her budget for this amount. Anita Bedwell made a motion to amend the library budget. Bobby McCartney seconded the motion. Mayor Calhoun stated all in favor say aye. All ayes. Mayor Calhoun declared the motion carried.

 

  1. Mayor Calhoun stated that Eddie Cline, Recreation Director, got a quote of $5,872.80 from the Decorator Store to tile and carpet the floors at the recreation center. This will include tearing out the old carpet and tile, and the labor cost for installation of the new carpet and tile.  He got a quote of $7,000.00 to replace the windows, from David Gettis, and a quote of $4596.00 to put up sheetrock, tear out the old sheetrock, and paint the center from Michael White Construction Company. Bobby McCartney made a motion to approve this work to be done. Larry Keenum seconded the motion. Mayor Calhoun stated all in favor say aye. All ayes. Mayor Calhoun declared the motion carried.   Mayor Calhoun said the funds for this project would come from the Trust Fund Monies.

 

  1. Mayor Calhoun presented Resolution No. 12-10, making Rainbow City part of the Alabama Emergency EMA Region, consisting of Calhoun, Clay, Cleburne, Etowah, Jefferson, St. Clair, and Talladega Counties. This is a mutual aid agreement for times of disaster. It lays a frame work for future interactions through the development of coordinated plans, but does not create any obligation or binding liability to participating entities. Tim Ramsey made a motion to adopt this resolution. Larry Keenum seconded the motion. Mayor Calhoun stated all in favor say aye. All ayes. Mayor Calhoun declared the motion carried.

 

  1. Mayor Calhoun said the five-year adjustment to Municipal Business License Issuance Fees will increase from $10.00 to $12.00, effective January l, 2013. Anita Bedwell made a motion to approve the adjustment. Bobby McCartney seconded the motion. Mayor Calhoun stated all in favor say aye. All ayes. Mayor Calhoun declared the motion carried.

 

  1. Mayor Calhoun announced that Sue Davis, Recreation Director, is retiring December 31, 2012. He recommended moving Mary Fox to Director at $9.50 per hour, Julia Scott to $8.50 per hour, and Jamie Dover to $8.00 per hour. Bobby McCartney made a motion to approve this request. Rick Hill seconded the motion. Mayor Calhoun stated all in favor say aye. All ayes. Mayor Calhoun declared the motion carried.

 

  1. Mayor Calhoun stated he would like to get gas cards for the police department.   Rick Hill made a motion to send out bids for the fleet cards for the department. This will be for gas and diesel. Tim Ramsey seconded the motion. Mayor Calhoun stated all in favor say aye. All ayes. Mayor Calhoun declared the motion carried.

 

  1. Mayor Calhoun stated that the application from the Etowah County Development, one-cent Recreation Project monies is ready to be completed. The City applies for this once a year, and is applying for $50,000.00 this year, for the Trail Head Project at the VLM Sports Complex entrance.   Bobby McCartney made a motion to complete the application for this project. Rick Hill seconded the motion. Mayor Calhoun stated all in favor say aye. All ayes. Mayor Calhoun declared the motion carried.

 

  1. Mayor Calhoun presented a request from Agnes Bentley, 301 Roseland Drive. She would like for her garbage fee to be waived until February 2013, because she is out of the country. She is not having her water turned off.   Died for lack of a motion.

 

  1. Mayor Calhoun presented a request for D.A.R.E./SRO Officer Justin Gilliland to attend   the 14th Annual Safe Schools training Conference in Gulf Shores, June 3-7, 2013.  Cost $150.00, with 5-night lodging fee. Rick Hill made a motion for him to attend. Larry Keenum seconded the motion. Mayor Calhoun stated all in favor say aye. All ayes. Mayor Calhoun declared the motion carried.

 

  1. Discussion was held concerning the selling of vacation days. Rick Hill made a motion that employees can sell a minimum of one (1) shift, up to a maximum of two (2) weeks. This week will be based on 56 hours per week for the fire department, 42 hours per week for patrol, and 40 hours per week for other employees. This request has to be given to the DEPARTMENT HEAD each month, and the department head will give to the Payroll Clerk, by the 10th of each month, and it will be paid the last payday of the month, if the City can fund it at that time. Tim Ramsey seconded the motion. Mayor Calhoun stated all in favor say aye. All ayes. Mayor Calhoun declared the motion carried.

 

  1. Mayor Calhoun asked that the records show that the following departmental reports were presented: Court, Fire, Police, Building, Library, and Community Center.

 

There being no further business to come before the Council at this time, Larry Keenum made a motion to adjourn.
