The City Council of the City of Rainbow City, Alabama, met in a regular session at City Hall at 6:30 p.m., and upon roll call by Barbara T. Wester, City Clerk/Treasurer, the following members answered present: Mayor: Terry John Calhoun, Council members: Anita Bedwell, Bobby McCartney, Lloyd Matthews, Larry Keenum and Kris Cornutt. The same constituting a quorum of the City Council, the following business was transacted. The meeting was called to order by Mayor Terry John Calhoun. Invocation was given by Bobby McCartney. Mayor Calhoun led the Pledge of Allegiance to the flag.

 

  1. Mayor Calhoun presented the minutes of August 27, 2012, and September 4, 2012 for review, and asked if there were any corrections, additions, or deletions. There being none, Lloyd Matthews made a motion to approve the minutes as presented. Larry Keenum seconded the motion. Mayor Calhoun stated all in favor say aye. All ayes. Mayor Calhoun declared the motion carried.

 

  1. Mayor Calhoun stated the clerk opened the bids for the gas and diesel fuel at 6:00 p.m. They are as follows: Green Oil Company, Oxford, Alabama: Regular unleaded gasoline, $3.3642, Midgrade unleaded gasoline, $3.5242, Off Road Diesel fuel, $3.3443. Ira Phillips, Gadsden, Alabama: Regular unleaded gasoline, $3.2525, Midgrade unleaded gasoline, $3.3625, Off Road Diesel fuel, $3.4343. Brown Oil Company, Gadsden, Alabama: Regular unleaded gasoline, $3.3642, Midgrade unleaded gasoline, $3.5242, Off Road Diesel fuel, $3.3398. Anita Bedwell made a motion to award the bid to Ira Phillips. Larry Keenum seconded the motion. Mayor Calhoun stated all in favor say aye. All ayes. Mayor Calhoun declared the motion carried.

 

  1. Mayor Calhoun stated this is a public hearing concerning Ordinance no. 487, the rezoning of Parcel B, Plat J-18, in Horizon Place, from Manufactured Home Park District to M-1, Manufacturing District.   Mayor Calhoun asked for comments. There was none.   Larry Keenum made a motion to introduce the ordinance. Anita Bedwell made a motion to suspend the rules for immediate consideration. Mayor Calhoun asked for a roll call vote as follows:

Anita Bedwell, yes; Bobby McCartney, yes; Lloyd Matthews, yes; Larry Keenum, yes; Kris Cornutt, yes; Mayor Calhoun, yes. Mayor Calhoun declared the motion carried.

 

Larry Keenum made a motion to adopt Ordinance no. 487. Mayor Calhoun asked for a roll call vote as follows: Anita Bedwell, yes; Bobby McCartney, yes; Lloyd Matthews, yes; Larry Keenum, yes; Kris Cornutt, yes. Mayor Calhoun declared the motion carried.

 

  1. Mayor Calhoun presented the resignation of Jenea McClendon, effective September 13, 2012, and turned it over to Larry Keenum, Police Department Chairman. Larry made a motion to accept the resignation, and post the position for ten (10) business days. Anita Bedwell seconded the motion. Mayor Calhoun stated all in favor say aye. All ayes. Mayor Calhoun declared the motion carried.

 

  1. Mayor Calhoun presented a request for an alcohol license application, for the Wagon Wheel Saloon. The new owner is Harold D. Cranford. Anita Bedwell made a motion to approve the request. Larry Keenum seconded the motion. Mayor Calhoun stated all in favor say aye. All ayes. Mayor Calhoun declared the motion carried.

 

  1. Mayor Calhoun asked Wiley McLain to explain the nuisance abatement at Lot 13, Horizon Place. Wiley said the trailer on this property burned 2 or 3 months ago, and the lady cannot afford to clean it up. He wants to bid out the clean-up, and then put a lien on the property. Discussion followed. Larry Keenum made a motion to approve this request. Lloyd Matthews

  1. Mayor Calhoun presented a request from Wiley McLain to attend the Alabama Association of Floodplain Managers Fall Conference in Auburn, October 22-24, 2012. Registration is $125.00, and room for three (3) nights. Larry Keenum made a motion to approve the request. Anita Bedwell seconded the motion. Mayor Calhoun stated all in favor say aye. All ayes. Mayor Calhoun declared the motion carried.

 

  1. Mayor Calhoun presented a request from Chief Carroll to declare the vest of Officer Brandon Mitchell as surplus. The vest cost $600.00. The City of Attalla wants to purchase the vest. Lloyd Matthews made a motion to declare the vest as surplus. Larry Keenum seconded the motion. Mayor Calhoun stated all in favor say aye. All ayes. Mayor Calhoun declared the motion carried. Bobby McCartney made a motion to sell the vest to the City of Attalla for $500.00. Anita Bedwell seconded the motion. Mayor Calhoun stated all in favor say aye. All ayes. Mayor Calhoun declared the motion carried.

 

  1. Mayor Calhoun presented a request from Chief Carroll to move $2,000.00 from the department’s Utilities budget (01-430-320) to General Supplies (01-430-300) in the 2011-2012 fiscal year. Anita Bedwell made a motion to approve this request. Larry Keenum seconded the motion. Mayor Calhoun stated all in favor say aye. All ayes. Mayor Calhoun declared the motion carried.

 

  1. Chief Carroll recommended the following: Sgt. Tommy Spurling to attend “Patrol Response to Street Narcotics course in Sheffield, Alabama, October l, 2012. The cost is $99.00 each for registration, plus lodging.   Animal Control Officer Tammie Valentini to attend the Tennessee Animal Care and Control Conference in Franklin, Tennessee, September 27-28, 2012, at a cost of $l70.00, plus lodging. Larry Keenum made a motion to approve the travel requests. Lloyd Matthews seconded the motion. Mayor Calhoun stated all in favor say aye. All ayes. Mayor Calhoun declared the motion carried.

 

  1. Mayor Calhoun presented an agreement between the Sheriff of Etowah County and Rainbow City for the cost of feeding the prisoners. It will be $4.00 per day for each prisoner Rainbow City has housed in the Etowah County Detention facility. He asked the Council for permission for him to sign the agreement on behalf of Rainbow City. Larry Keenum made a motion to approve the request. Bobby McCartney seconded the motion. Mayor Calhoun stated all in favor say aye. All ayes. Mayor Calhoun declared the motion carried.

 

  1. Mayor Calhoun presented a request from Tim Jones, for the City to sponsor books for students in the 2nd grade at John Jones and Westbrook. There are 176 books at a cost of $2.93 a book, for an amount of $515.68. Died for lack of a motion.

 

  1. Mayor Calhoun read a memo from Jennifer Miller concerning putting speed breakers on Hollingsworth Avenue. Discussion followed. Died for lack of a motion.

 

  1. Mayor Calhoun presented a check from the Alabama Department of Revenue in the amount of $5,592.62. It is the city’s share of the Financial Institution Excise Tax collected from banks and other financial institutions operating in Rainbow City, for the period of August 1, 2011, through July 31, 2012.

 

  1. Anita Bedwell said it is “Get Your Library Card Month.” She also said the library has done a lot of upgrading.

 

 

There being no further business to come before the Council at this time, Larry Keenum made a motion to adjourn.
