The City Council of the City of Rainbow City, Alabama, met in regular session at City Hall at 6:30 p.m., and upon roll call by the City Clerk, Barbara T. Wester, the following members answered present: Mayor, Terry John Calhoun, Council members, Anita Bedwell, Bobby McCartney, Lloyd Matthews, Larry Keenum and Kris Cornutt. The same constituting a quorum of the City Council, the following business was transacted. The meeting was called to order by Mayor Calhoun. Invocation was given by Anita Bedwell. Mayor Calhoun led the Pledge of Allegiance to the flag.

 

Mayor Calhoun presented the minutes of August 23, 2010 for review and asked if there were any corrections, additions, or deletions. There being none, Bobby McCartney made a motion to approve the minutes as presented. Lloyd Matthews seconded the motion. Mayor Calhoun stated all in favor say aye. All ayes. Mayor Calhoun declared the motion carried.

 

Mayor Calhoun stated the building official said the Community Center can be painted for less than the bid law, so we do not have to take bids. He also said he hopes there is enough money left in the grant funds the City received to paint the Boy Scout Cabin. Lloyd Matthews made a motion to paint both places pending a price for each. Kris Cornutt seconded the motion. Mayor Calhoun stated all in favor say aye. All ayes. Mayor Calhoun declared the motion carried.

 

Mayor Calhoun said bids were received and opened August 26, 2010 for the Lumley Road Trail Project No. 098004-00. Grant funds available for construction are $474,237.00. Bids were received from the following for the base bid and alternate#1 and alternate #2:

 

(1) Bostic Trucking & Excavating—$470,184.70

(2) Coston General Contractors—$502,628.00

(3) Walker Patton Co.—$417,431.78

(4) Bedwell & Whorton—453,826.03

(5) James E. Watts & Sons—$517,528.40

 

Bobby McCartney made a motion to award the low bid to Walker Patton Company. Lloyd Matthews seconded the motion. Mayor Calhoun stated all in favor say aye. All ayes, except Anita Bedwell who abstained. Mayor Calhoun declared the motion carried.

 

Mayor Calhoun presented a request from the Etowah County Community Services Program, Inc. for funding. Lloyd Matthews made a motion to give the same amount given last year, which is $l,000.00. Kris Cornutt seconded the motion. Mayor Calhoun stated all in favor say aye. All ayes. Mayor Calhoun declared the motion carried.

Mayor Calhoun stated the clerk received no bids for the Lexmark printer in the court office that was surplused at the last council meeting. Bobby McCartney made a motion for the printer to be destroyed. Kris Cornutt seconded the motion. Mayor Calhoun stated all in favor say aye. All ayes. Mayor Calhoun declared the motion carried.

 

Mayor Calhoun presented the following monthly departmental reports:   Library, Community Center, Court, Building Department, Police and Fire Department. He asked for comments. There were none. He then asked that the records show that the reports were presented.

 

Mayor Calhoun presented the attached list from the library department to be surplused. Lloyd Matthews made a motion to surplus the items and put them on govdeals .com. Kris Cornutt seconded the motion. Mayor Calhoun stated all in favor say aye. All aye.

Mayor Calhoun declared the motion carried.

 

Mayor Calhoun presented a request from Wiley McLain to attend the Floodplain Managers Fall Conference in Auburn, October 18-20, 2010.   Larry Keenum made a motion for Wiley to attend the conference. Lloyd Matthews seconded the motion. Mayor Calhoun stated all in favor say aye. All ayes. Mayor Calhoun declared the motion carried.

 

Mayor Calhoun presented a recommendation from the Building Department to abate a nuisance at 1196 Grady Street. Lloyd Matthews made a motion to abate the nuisance, subject to a title search by the City Attorney, to confirm proper ownership. Kris Cornutt seconded the motion. Mayor Calhoun stated all in favor say aye. All ayes. Mayor Calhoun declared the motion carried.

 

Mayor Calhoun presented a request from Bellsouth for a 740 sq. foot right-of-way easement for them on Lister Ferry Road near the Rainbow City Library to update the phone system. Lloyd Matthews made a motion to approve the request. Kris Cornutt seconded the motion. Mayor Calhoun stated all in favor say aye. All ayes. Mayor Calhoun declared the motion carried.

 

Mayor Calhoun stated the City needs to hire Justin Hayes as a Public Defender to use when we need him. Anita Bedwell made a motion to hire him. Lloyd Matthews seconded the motion.   Mayor Calhoun stated all in favor say aye. All ayes. Mayor Calhoun declared the motion carried.

 

Mayor Calhoun presented a request from Local Joes Trading Post, LLC requesting approval to sell retail table wine. The business is owned by Elizabeth McNeal and is located at 4967 Rainbow Drive. Lloyd Matthews made a motion to approve the request. Anita Bedwell seconded the motion. Mayor Calhoun stated all in favor say aye. All ayes. Mayor Calhoun declared the motion carried.

 

Mayor Calhoun presented a letter from the Etowah County Task Force thanking Greg Payne and his department for their help in debris removal at Spring Lake Lodge Apartments.

 

Mayor Calhoun asked the Council to give him the authority to get an appraisal on the Copeland property near the Vivian Lee Maddox Sports Complex. Lloyd Matthews made a motion for the Mayor to get the appraisal done. Bobby McCartney seconded the motion. Mayor Calhoun stated all in favor say aye. All ayes. Mayor Calhoun declared the motion carried.

 

Jason Green, firefighter, appeared before the Council to discuss the department selling pink t-shirts for breast cancer. The department has already sold 700 shirts and have ordered 250 more. The money received will go to the American Cancer Society to be earmarked for breast cancer.

 

Lloyd Matthews made a motion to add a speed breaker in Westminster between the 300 and 400 block.   Kris Cornutt seconded the motion. Mayor Calhoun stated all in favor say aye. All ayes. Mayor Calhoun declared the motion carried.

 

Bobby McCartney stated he would like for the Council to look at the grass situation at the VLM Complex and discuss it at the next meeting.

 

There being no further business to come before the Council at this time, Kris Cornutt made a motion to adjourn.
